New Choice Homes – “10 Month Build Time Assurance” Promotion: Terms and Conditions

These terms and conditions apply to the promotion by Essential First Choice Homes Pty Ltd (ACN 138 185 341) trading as New Choice Homes (New Choice Homes, us, we, our) known as the “10 Month Build Time Assurance”, under which New Choice Homes assures, represents or states to customers or potential customers (you or your) that a home built by New Choice Homes will be built within 10 months.

The Build Time Assurance

  • Subject to these terms and conditions, New Choice Homes undertakes that practical completion of a home the subject of a signed Preparation of Plans Agreement will be no longer than 10 months after the first brick is laid on your home (as determined by New Choice Homes, acting reasonably) (Build Time Assurance).
  • These terms are important. You should read them.  These terms outline when the Build Time Assurance does not apply.  These terms also set out when New Choice Homes does not have to comply with the Build Time Assurance.

What contracts and homes does the Build Time Assurance apply to?

  • The Build Time Assurance only applies to the construction of a home that is the subject of a signed Preparation of Plans Agreement entered into between 14 March 2022 to 14 June 2022 (inclusive) (Offer Period), which is not terminated. If you do not enter into a Preparation of Plans Agreement during the Offer Period, the Build Time Assurance does not apply. The Offer Period may be extended at New Choice Homes’ sole discretion.
  • The Build Time Assurance only applies to the following types of homes:
    1. a single-storey home on a green title or survey strata lot;
    2. duplex and triplex developments on a strata title lot (each home will be the subject of a separate contract);
    3. a home that has a design from the New Choice Homes standard design range;
    4. the home design does not materially vary from the standard New Choice Homes design (as determined by New Choice Homes); and
    5. a home that is to be located in the Perth to Peel area between Dawesville in the south, Two Rocks in the north and an area to the east as determined by New Choice Homes.

When will the Build Time Assurance not apply or cease to apply?

  • The Build Time Assurance does not apply in the following circumstances, and will cease to apply if any of the following occur after the relevant Preparation of Plans Agreement is signed:
    1. If there is a variation to the design or specifications of the home, or if the building contract is varied in any way. In our discretion, we may decide in these circumstances that the Build Time Assurance continues to apply, on certain terms.  This means that if you change your mind about the build, specifications or design of the home, we can no longer promise to complete the home within 10 months after the first brick is laid.
    2. If you fail to provide any fixtures fittings or chattels which are required for the works at the time they are required.
    3. If there are any building or other works relating to the home which are arranged by you. This means the Build Time Assurance does not apply if you arrange your own subcontractors or trades to perform any works to be carried out at the same time as the building work by us or specify that we are to use any specific subcontractors or trades.
    4. If the Preparation of Plans Agreement or building contract are terminated by any party.
  • The Build Time Assurance will cease to apply if New Choice Homes determines that you have breached the terms of the Preparation of Plans Agreement or building contract. This would include failing to pay a progress payment or other amount when due.  New Choice Homes will determine whether there has been a breach, and a breach will occur whether or not we’ve given a notice of default.

What happens if there’s delays outside of New Choice Homes’ control?

  • The Build Time Assurance will be extended, at New Choice Homes’ election, if building works on the relevant home are delayed due to events or circumstances outside the reasonable control of New Choice Homes, so long as New Choice Homes taken reasonable steps to avoid that event or circumstance, including the matters listed below (Delay Event).
  • These types of events include the following:
    1. an act of God, fire, explosion, earthquake, landslide, flood, washout, lightning, storm, tempest, or otherwise inclement weather;
    2. strike, lockout, holidays granted in accordance with industrial laws, stoppage or restraint of labour or other industrial disturbance or dispute (whether lawful or unlawful);
    3. war (declared or undeclared), act of public enemies, military action, insurrection, riot or civil commotion;
    4. expropriation by any governmental or military agency or authority, sabotage, restraints, embargoes or other acts by any governmental agency or authority;
    5. breakdown of or accident to plant, machinery or equipment;
    6. a shortage in the supply of labour, materials or delays in transport;
    7. acts of vandalism, damage or theft in relation to the building;
    8. any restrictions or interruption (including the availability of materials or labour) which is required or directed by a government agency imposed to deal with the family of viruses known as novel coronavirus COVID-19;
    9. alterations to the building works;
    10. any interference to the building works by any act or omission by you; or
    11. any delay caused by legal proceedings in respect of the property or building works or an order of a relevant authority;
    12. any other matter that extends the time for practical completion under the relevant building contract.
  • If New Choice Homes determines that a Delay Event has occurred, New Choice Homes may by notice to you (at any time):
    1. extend the end of the Build Time Assurance by a period that is equal to the expected delay caused by the Delay Event (as determined by New Choice Homes); or
    2. cancel and terminate the Build Time Assurance.

Compensation

  • Subject to the above terms, if your home is not built to practical completion within 10 months from the date the first brick is laid, New Choice Homes will pay you a weekly amount of $400 until the home is completed, up to a maximum of 5 weeks. Those payments will be taken into account in respect of the payments to be made under the relevant home building contract.

General

  • These terms and conditions are governed by the law of Western Australia.

The rent.com.au promotion includes packages starting from $256 per week; pricing as at Feb 2022.
Get started with a $2,000 deposit is the amount paid to New Choice Homes to commence Preparation of Plans Agreement (Additional to land deposit and any finance deposit requirements)

Win Your Rent For 3 Months Up To $5,000 – Competition #2

Terms and Conditions

1. The Promoter is Essential First Choice Homes Pty Ltd (ACN 138 185 341) trading as New Choice Homes (New Choice Homes).

2. The name of this Competition is the “Win Your Rent” competition (Competition).

3. This document, instructions on how to enter the Competition and any other details contained within promotional advertisements form part of the Terms and Conditions.

4. Participation in the Competition constitutes the entrant’s unconditional agreement to, and acceptance of, the Terms and Conditions.

5. To the maximum extent permitted by law, New Choice Homes’ decision is final and no correspondence will be entered into in relation to any dispute or other matter arising in relation to the Competition.

6. The Competition commences at [Friday 18th February 2022] and entries close and must be received by [Thursday 30th June 2022] (Competition Period).

Eligibility

7. Subject to clause 8, entry is open to Western Australian residents who:

(a) are aged at least 18 years old, primarily reside in rented accommodation under a residential tenancy agreement;

(b) have entered into a home building contract with New Choice Homes (in respect of  which formal unconditional finance approval has been received by New Choice Homes’ customer) and which is not terminated by the prize draw date, as specified in these Terms and Conditions;

(c) not have won a competition promoted by New Choice Homes in the previous 12 months; and

(d) elect to receive marketing and promotional materials from New Choice Homes.

(Eligible Entrants).

8. Employees, contractors, suppliers and agents of New Choice Homes and their immediate family members are not eligible to enter the Competition and if such an entry is submitted, it will not be valid. A reference to an immediate family member refers to a person’s spouse, de facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, brother, sister, step-brother or step-sister, grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, stepsisters or first cousin.

To enter the Competition, Eligible Entrants must during the Competition Period  must scan the QR code entry and supply their name, contact phone number and email address (Eligible Entry).

9. An Eligible Entrant can only submit one Eligible Entry.

10. Any entry submitted by a person who does not satisfy the eligibility conditions detailed in the Terms and Conditions will not be valid.

11. An Eligible Entry is deemed to be received at the time it is received by New Choice Homes and not at the time of transmission by the Eligible Entrant.

12. A maximum of one Eligible Entry will be accepted from each Eligible Entrant.  The first Eligible Entry received by New Choice Homes from an Eligible Entrant will be considered the Eligible Entrant’s official entry. New Choice Homes reserves the right to disqualify entries where New Choice Homes considers, in its sole discretion, that the entry has been submitted from a fake user or a person who has already submitted an Eligible Entry.

13. New Choice Homes reserves the right to disqualify entries which are misleading, incomplete, indecipherable, illegal or offensive or otherwise in breach of these Terms and Conditions.

Prize

14. The prize will be the amount of an Eligible Entrant’s substantiated rental as at the date of the Eligible Entry (as determined by New Choice Homes for a 3 month period (Substantiated Amount) up to a maximum amount of $5,000 (or approximately $400 a week) (Prize).

15. There will be 1 Prize awarded to 1 Eligible Entrant who submitted an Eligible Entry selected at random.  The maximum total prize pool value is $5,000.

16. The Prize will be processed as a cash deposit into the winner’s nominated bank account only after:

(a) the winner has contacted New Choice Homes to accept the Prize within the time specified in these Terms and Conditions;

(b) the winner has provided New Choice Homes with bank account details and identification when accepting the Prize and had their identity verified by New Choice Homes;

(c) New Choice Homes is satisfied that the winner’s home building contract with New Choice Homes is current and has not terminated; and

(d) the winner has provided New Choice Homes with evidence to substantiate their current rental payments as at the date of the Eligible Entry (to the satisfaction of New Choice Homes).

17. If the Prize is unavailable for any reason, New Choice Homes may substitute a prize of equivalent value and the winner agrees to accept that substitute prize.

18. Any prize must be taken “as offered” and cannot be transferred, exchanged, varied or extended.

19. The winner will be randomly selected by a New Choice Homes staff member via a digital program at New Choice Home’s office at 24 Sangiorgio Court, Osborne Park  after 12:00pm AWST on [Thursday 7th July]. The winner will be notified via email or telephone within 48 hours of being drawn. New Choice Homes will require appropriate contact details and identification from the winner in order to provide the Prize.

20. New Choice Homes reserves the right to redraw the winner of the Prize if the winner is unable to satisfy these Terms and Conditions, forfeits or does not claim the Prize. The winner will forfeit the Prize if the winner does not respond within 10 business days accepting the Prize. If the winner forfeits or does not claim the Prize as at [Thursday 14th July], a further draw for the winner of the Prize will be conducted on [Friday 15th July] at the same place as the original draw and as otherwise provided for in these Terms and Conditions (subject to any applicable law). The winner of the further draw must respond to collect the Prize in compliance with these Terms and Conditions by [Friday 29th July].

21. To the maximum extent permitted by law, New Choice Homes’ decision regarding the Prize, determination of Eligible Entries and winners, and the conduct of the Competition is final and no correspondence will be entered into in relation to any dispute or other matter arising in relation to the Competition.

General

22. The Prize is issued by Essential First Choice Homes Pty Ltd (ACN 138 185 341) (Builders Registration No. BC13070). Please read the terms and conditions applicable to any home building contract before making any decision about our products and services.

23. By entering the Competition, all entrants authorise New Choice Homes to use the entry content for promotional, marketing, advertising and other business purposes without requiring any additional consent from the entrant and without compensating the entrant.

24. The winner agrees and consents to:

(a) participate and co-operate in any promotional activities relating to the Competition, including being interviewed and photographed; and

(b) New Choice Homes using the winner’s name, entry, likeness, image and voice (including photograph, film and recording of the same) in any media for an unlimited period of time without remuneration for the purpose of promoting the Competition (including any outcome), New Choice Homes and any products and services supplied by New Choice Homes.

25. By entering the Competition, entrants acknowledge and agree their entry data will be managed by New Choice Homes who take reasonable commercial steps to secure information in accordance with the Australian Privacy Principles under the Privacy Act 1988 (Cth). Entrants’ information will be stored in Australia for the duration of the competition and will be permanently deleted within a reasonable time. The information will be used in accordance with New Choice Homes’ Privacy Policy available at https://www.newchoicehomes.com.au/privacy-policy/. Entrants must notify New Choice Homes if they would like to amend their personal information or if they have any queries as to how their personal information will be used.

26. Except for any liability that cannot be excluded by law, New Choice Homes (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Competition, including, but not limited to, where arising from the following:

(a) any technical difficulties or equipment malfunction (whether or not under the New Choice Homes’ control);

(b) any theft, unauthorised access or third party interference;

(c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by New Choice Homes ) due to any reason beyond the reasonable control of New Choice Homes;

(d) any variation in prize value to that stated in these Terms and Conditions;

(e) any tax liability incurred by a winner or entrant; or

(f) use of the Prize.

27. New Choice Homes reserves the right to:

(a) declare as void any entries or claims for prizes resulting from any printing, production or distribution errors or where there has been error in any aspect of the preparation for or conduct of the Competition materially affecting the result of the Competition or the number of winners or the value of claims for prizes;

(b) add to or to waive any of the Terms and Conditions;

(c) change the duration of the Competition; and

(d) cancel the Competition or any part of it at any stage in the event of circumstances beyond New Choice Homes’ control,

subject to the approval of the Gaming and Wagering Commission (WA) or other relevant authority (if and only to the extent required).

28. If the Competition is conducted on, or utilising, social media including, without limitation Facebook, Instagram and Twitter, the Competition shall be subject to the terms of use governing the applicable social media platform. In the event of an inconsistency between these Terms and Conditions, and the terms of use of the applicable social media platform, the terms of the applicable social media platform shall prevail.

29. Without prejudice to clause 28 above, if the Competition is conducted on a social media platform, entrants:

(a) fully release that social media platform from all liability arising out of the Competition;

(b) acknowledge that the Competition is in no way sponsored, endorsed or administered by, or associated with, that social media platform; and

(c) understand and accept that information disclosed in connection with the Competition is disclosed to New Choice Homes and not that social media platform.

30. The Competition is governed by, and these Terms and Conditions are to be interpreted in accordance with, the laws of Western Australia.

A referrer is the person who refers an individual to the company. The referrer will receive $1000 paid into their nominated bank account 30 days after the referred persons home has gone into construction and Slab has been laid.

  • The referrer must give their full name and address and referring person’s full details on either New Choice Homes website or filling out our referral form.
