Independent Building Inspector Offer – 1st January 2024

These terms and conditions apply to the promotion by Essential First Choice Homes Pty Ltd (ACN 138 185 341) trading as New Choice Homes (New Choice Homes, us, we, our) known as the “Independent Building Inspector”, under which New Choice Homes assures, represents or states to customers or potential customers (you or your) that a home built by New Choice Homes will have the option to have two independent building inspections carried out at no additional cost by Home Integrity Building Consultants.
To ensure your peace of mind that your new home has been constructed as required by the Contract and all applicable codes and standards, New Choice Homes offers to arrange and cover the costs of two (2) building inspections by ‘Home Integrity Building Consultants’.
This offer applies to a contract entered into for the construction of a New Choice Home between 1st January 2024 and 31st March 2024 and entitles the Client to elect to receive two (2) building inspections on the terms as set out below. Terms used in this offer are as per the Contract.
Home Integrity Building Consultants are an independent building inspection company (Home Integrity). Home Integrity will conduct up to two (2) independent inspections of your new home to assess the construction against the plans, specifications and applicable codes and standards.
First Inspection – Roof Frame
The first inspection will be performed at completion of the roof frame stage, and includes an extensive review of all elements relating to the home’s structural integrity, including inspections of: plumbing and electrical layouts; the visible slab; window and door frame locations and installation; brickwork; tie-down points and straps, and roof construction.
Second Inspection – Practical Completion
The second inspection will be performed when your home is at Practical Completion. The inspection will thoroughly review the final construction and finishes and Home Integrity’s building inspector will meet with you on-site and review and assess any additional items you may identify.
After the Inspection
The New Choice Homes site supervisor for the home will receive a copy of the report in order that they can attend to any issues identified.
Home Integrity will contact you by phone after each inspection to discuss the inspection report and provide you with an extensive checklist of the items covered. The building inspector can be contacted to assist with any concerns identified in the report.
On receipt of the report New Choice Homes shall undertake such works as it considers are required to be attended to in order to achieve Practical Completion and handover, and attend to any other items during the Defects Liability Period. The Client must provide reasonable access during business hours as required for any works attended to after handover.
Should you elect not to accept this offer, then you are of course free to choose an alternative building inspector (at your own expense).
What contracts and homes does the Independent Building Inspector Offer apply to?
1) The Independent Building Inspector Offer only applies to the construction of a home that is the subject of a signed Preparation of Plans Agreement entered into between 1st January 2023 to the 31st of March 2024 (inclusive) (Offer Period), which is not terminated.
2) If you do not enter into a Preparation of Plans Agreement during the Offer Period, the Independent Building Inspector Offer does not apply. The Offer Period may be extended at New Choice Homes’ sole discretion.
3) Contracts and homes that have notified New Choice Homes in writing of their wish to accept the offer to appoint Home Integrity as their independent building inspector.
When will the Independent Building Inspector Offer (Jan 2024) not apply or cease to apply?
4) The Independent Building Inspector Offer does not apply in the following circumstances, and will cease to apply if any of the following occur after the relevant Preparation of Plans Agreement is signed:
a. If you fail to provide in writing your wish to appoint Home Integrity as their independent building inspector.
b. If you notify New Choice Homes in writing that you do wish to appoint Home Integrity as your independent building inspector.
c. If the Preparation of Plans Agreement or building contract are terminated by any party.
5) In the event that one or more of the events listed in section 4 above occurs, New Choice Homes may decide that the Independent Building Inspector Offer continues to apply, on certain terms and in its sole discretion.
The Independent Building Inspector Offer will cease to apply if New Choice Homes determines that you have breached the terms of the Preparation of Plans Agreement or building contract. This would include failing to pay a progress payment or other amount when due. New Choice Homes will determine whether there has been a breach, and a breach will occur whether or not we’ve given a notice of default.
General
6) These terms and conditions are governed by the law of Western Australia.

7) The “Independent Building Inspector Offer” end date: 31st of March 2024.

12 Month Build Time Assurance –  Promotion start date 1st January 2024

These terms and conditions apply to the promotion by Essential First Choice Homes Pty Ltd (ACN 138 185 341) trading as New Choice Homes (New Choice Homes, us, we, our) known as the “12 Month Build Time Assurance”, under which New Choice Homes assures, represents or states to customers or potential customers (you or your) that a home built by New Choice Homes will be built within 12 calendar months.

Build Time Assurance

  • Subject to these terms and conditions, New Choice Homes undertakes that practical completion of a home the subject of a signed Preparation of Plans Agreement will not be longer than 12 months (calculated as 12 calendar months eg. 1st January 2024 to 1st January 2025) after the first brick is laid on your home (as determined by New Choice Homes, acting reasonably) (Build Time Assurance).
  • These terms are important. You should read them.  These terms outline when the Build Time Assurance does not apply.  These terms also set out when New Choice Homes does not have to comply with the Build Time Assurance.

What contracts and homes does the Build Time Assurance apply to?
3) The Build Time Assurance only applies to the construction of a home that is the subject of a signed Preparation of Plans Agreement entered into between 1st January 2023 to the 31st March 2024 (inclusive) (Offer Period), which is not terminated.
4) If you do not enter into a Preparation of Plans Agreement during the Offer Period, the Build Time Assurance does not apply. The Offer Period may be extended at New Choice Homes’ sole discretion.
5) The Build Time Assurance only applies to the following types of homes:
a) a single-storey home on a green title or survey strata lot;
b) duplex and triplex developments on a strata title lot (each home will be the subject of a separate contract);
c) a home that has a design from the New Choice Homes standard design range (up to a maximum of 300m2);
d) the home design does not materially vary from the standard New Choice Homes design (as determined by New Choice Homes); and
e) a home that is to be located in the Perth to Peel area between Dawesville in the south, Two Rocks in the north, Bullsbrook in the north-east (excluding Lower Chittering), and an area to the south-east as determined by New Choice Homes.
When will the Build Time Assurance not apply or cease to apply?
6) The Build Time Assurance does not apply in the following circumstances, and will cease to apply if any of the following occur after the relevant Preparation of Plans Agreement is signed:
a) If there is a material variation to the design or specifications of the home, or if the building contract is materially varied in any way which impacts the time for completion of the work (as determined by us). This means that if you change your mind about the build, specifications or design of the home in a way that impacts on the time for completion, we can no longer promise to complete the home within 12 months after the first brick is laid.
b) If you fail to provide any fixtures fittings or chattels which are required to be provided by you under the building contract at the time they are required to be provided for the works.
c) If there are any building or other works relating to the home which are arranged by you. This means the Build Time Assurance does not apply if you arrange your own subcontractors or trades to perform any works to be carried out at the same time as the building work by us or specify that we are to use any specific subcontractors or trades.
d) If the Preparation of Plans Agreement or building contract are terminated by any party.
7) In the event that one or more of the events listed in section 6 above occurs, New Choice Homes may decide that the Build Time Assurance continues to apply, on certain terms and in its sole discretion.
8) The Build Time Assurance will cease to apply if New Choice Homes determines that you have breached the terms of the Preparation of Plans Agreement or building contract. This would include failing to pay a progress payment or other amount when due. New Choice Homes will determine whether there has been a breach, and a breach will occur whether or not we’ve given a notice of default.
What happens if there are delays outside of New Choice Homes’ control?
9) The Build Time Assurance may be extended, at New Choice Homes’ election, if building works on the relevant home are delayed due to events or circumstances outside the reasonable control of New Choice Homes, so long as New Choice Homes taken reasonable steps to avoid that event or circumstance, including the matters listed below (Delay Event).
10) These types of events include the following:
a) breakdown of or accident to plant, machinery or equipment;
b) a shortage in the supply of labour, materials or delays in transport;
c) acts of vandalism, damage or theft in relation to the building;
d) any restrictions or interruption (including the availability of materials or labour) which is required or directed by a government agency imposed to deal with the family of viruses known as novel coronavirus COVID-19;
e) alterations to the building works;
f) any interference to the building works by any act or omission by you;
g) any delay caused by legal proceedings in respect of the property or building works or an order of a relevant authority;
h) any other matter that extends the time for practical completion under the relevant building contract;
i) an act of God, fire, explosion, earthquake, landslide, flood, washout, lightning, storm, tempest, or otherwise inclement weather;
j) strike, lockout, holidays granted in accordance with industrial laws, stoppage or restraint of labour or other industrial disturbance or dispute (whether lawful or unlawful);
k) war (declared or undeclared), act of public enemies, military action, insurrection, riot or civil commotion; or
l) expropriation by any governmental or military agency or authority, sabotage, restraints, embargoes or other acts by any governmental agency or authority.
11) If New Choice Homes determines that a Delay Event has occurred, New Choice Homes may by notice to you (at any time):
a) extend the end of the Build Time Assurance by a period that is equal to the expected delay caused by the Delay Event (as determined by New Choice Homes); or
b) cancel and terminate the Build Time Assurance.
Compensation
12) Subject to the above terms, if your home is not built to practical completion within 12 months from the date the first brick is laid, New Choice Homes will credit a weekly amount of $400 per week until the home is completed, up to a maximum of 5 weeks ($2,000 total).
13) The total amount of any such credit shall be deducted from the next progress claim amount payable to New Choice Homes under the Building Contract.
14) In the event of any claim for delay damages for late completion under the building contract, the amount credited in respect of the Build Time Assurance will be deducted from any delay damages otherwise payable.
15) The amount of $2,000 is the total amount of any liability (under contract, statute or otherwise) that New Choice Homes may have to you arising out of or in connection with the Build Time Assurance.
General
16) These terms and conditions are governed by the law of Western Australia.

17) The 12 Month Build Assurance” end date: 31st of March 2024

Christmas Giveaway – December 2023

  • The competition is open to residents of Perth Metropolitan area, Western Australia.
  • There is no entry fee and no purchase necessary to enter this competition.

These terms and conditions apply to the promotion by Essential First Choice Homes Pty Ltd (ACN 138 185 341) trading as New Choice Homes (New Choice Homes, us, we, our) known as the Ultimate Value Promotion October 2023.

  • The Ultimate Value promotion only applies to the Zeus, the Apollo and the Winston designs in the Freedom specification.
  • Minor design changes are permitted to the floor plans within reason, major structural changes where the design has been recreated will not be accepted.

Lifetime Structural Guarantee:

  • The More Comfort More Savings Promotion only applies to the construction of a home that is the subject of a signed Preparation of Plans Agreement entered into between 2 August 2023 to 31st of August 2023 (inclusive) (Offer Period), which is not terminated. There will be no extension to the offer period.
  • Promotion is only applicable to the Freedom and Signature home designs.
  • The promotion will only be provided where the client has paid a full non-refundable deposit to New Choice Homes.
  • The Client must obtain unconditional formal finance approval.
  • Promotion is exclusive of double story designs.
  • Promotion is inclusive of individual designs which are no larger than 300sqm in size.
  • Individual designs which are larger than 300sqm are excluded from this promotion.
  • At time of sale Annexure 8 More Comfort More Savings Promotion flyer must be signed by Client to acknowledge the choice of:

  1. In these terms and conditions and any marketing materials and advertisements relating to the Promotion, the promoter is Essential First Choice Homes Pty Ltd (ACN 138 185 341), trading as New Choice Homes (“New Choice Homes“).
  2. In these terms and conditions and any marketing materials and advertisements relating to the Promotion, Peet means Peet Estates (WA) Pty Ltd, Level 7, 200 St. Georges Terrace, Perth WA 6000 selling land within Brabham Estate (“Peet“).
  3. The Promotion runs from 1PM on 3 June 2023 until 5PM on 28 June 2023 (‘Promotion Period‘).
  4. The Promotion only applies to entries completed at the New Choice Homes display located at 35 Propeller Avenue Brabham, and Brabham Sales Centre located on the corner of Youle-Dean Road and Isoodon Street, during the Promotion Period. 
  5. The Promotion is only valid during the Promotion Period, and is correct as at the time of publication, but may change at Peet’s absolute discretion at any time.
  6. New Choice Homes and Peet give no warranty and makes no representation as to the accuracy or sufficiency of any description, illustration, photograph or statement contained in any advertisement, or any information or statements made or given by its employees, agents or contractors, and will not be liable for any loss or damage suffered or incurred by any party who relies upon the information in any advertisement, publication or statement except for any liability which cannot be excluded by law.

 

Eligibility

  1. To be eligible to participate in the Promotion, a person (“Entrant“) must during the Promotion Period complete in full and submit an entry form (“Entry Form“) at the New Choice Homes display in Brabham, and at the Brabham Sales Centre.
  2. An entrant must also be an Australian resident to enter.
  3. New Choice Homes and Peet employees, their immediate family members, and Peet contractors are not eligible to win.

  15. Entrants must, at the Promoter’s request, participate in all promotional activity (such as publicity and photography) surrounding this promotion or the winning of any prize, free of charge, and they consent to the Promoter and its related bodies corporate using their name and image in promotional Without limitation, entrants consent to be broadcast, filmed, photographed or otherwise recorded without compensation while participating in this promotion, or any challenge involved in this promotion, or in taking or using any prize, and they consent to the Promoter repeating any such broadcast, film or other recordings at any time.

The Promise 2.0 – “6 Month Start Time Guarantee”

These terms and conditions apply to the promotion by Essential First Choice Homes Pty Ltd (ACN 138 185 341) trading as New Choice Homes (New Choice Homes, us, we, our) known as the “6 Month Start Time Guarantee”, under which New Choice Homes assures, represents or states to customers or potential customers (you or your) that work on the construction of your new home will commence within 6 months of the Certificate of Acceptance.

1) Subject to these terms and conditions, New Choice Homes undertakes that the new home build will commence within 6 months of the Certificate of Acceptance (6 Month Start Time Guarantee).

2) These terms are important. You should read them. These terms outline when the 6 Month Start Time Guarantee does and does not apply.

6 Month Start Time Guarantee

3) New Choice Homes guarantees that the earthworks will be started within 6 months from the date on the ‘Certificate of Acceptance.’

4) If New Choice Homes does not comply with the 6 Month Start Time Guarantee it will credit to you a weekly amount of $400 for up to a maximum of 5 weeks (total amount capped at $2,000).

5) The number of weeks delay (if any) shall be calculated by New Choice Homes, based on the period of any delay in laying the slab, beyond the 6 month period from the Certificate of Acceptance.

6) The total amount of any such credit shall be deducted from the next progress claim amount payable to New Choice Homes under the Building Contract.

7) The amount of $2,000 is the total amount of any liability (under contract, statute or otherwise) that New Choice Homes may have to you arising out of or in connection with the 6 Month Start Time Guarantee.

When does the 6 Month Start Time Guarantee apply to?

8) The 6 Month Start Time Guarantee only applies to the construction of a new home that is the subject of a signed Building Contract entered into between You and New Choice Homes between 10th November 2022 and 28th February 2023 (inclusive) (Offer Period), which is not terminated.

9) If you do not enter into a Building Contract during the Offer Period, the 6 Month Start Time Guarantee does not apply. The Offer Period may be extended at New Choice Homes’ sole discretion.

10) The 6 Month Start Time Guarantee only applies to a new single-storey home from the New Choice Homes standard design range which does not materially vary from the standard design (as determined by New Choice Homes).

11) To qualify for, and for the 6 Month Start Time Guarantee to apply, you must have a ‘Certificate of Acceptance’ issued by New Choice Homes. The Certificate of Acceptance will be issued once the deposit has been paid in full and the following documents have been submitted and accepted by New Choice Homes:

a) a signed Quotation acceptance;

b) an executed Preparation of Plans Agreement;

c) a signed sketch; and

d) an executed offer and acceptance.

12) The 6 Month Start Time Guarantee only applies where the prestart process is completed within 20 Working Days of entering the Building Contract.

13) The above requirements may be waived in whole or part at New Choice Homes’ sole discretion.

When will the 6 Month Start Time Guarantee not apply?

14) The 6 Month Start Time Guarantee does not apply in the following circumstances, and is subject to the sole discretion of New Choice Homes:

a) If there is a material variation to the design or specifications of the home;

b) If the Prestart process is not completed within 20 working days. This means that if you change your mind about the build, specifications or design of the home, we can no longer promise to maintain the 6 Month Start Time Guarantee of your new home build.

c) If the work on Site is delayed by any inability on the part of the owner to obtain finance;

d) If the work on Site is delayed by any issues related to the issuing of the title or any denial of access to the site (however caused);

e) If there are any building or other works relating to the home which are arranged by you. This means the 6 Month Start Time Guarantee does not apply if you arrange your own subcontractors or trades to perform any works to be carried out at the same time as, or prior to, the building work by New Choice Homes or specify that we are to use any specific subcontractors or trades.

f) If the Preparation of Plans Agreement or Building Contract are terminated by any party.

g) If New Choice Homes determines that you have breached the terms of the Preparation of Plans Agreement or Building Contract. New Choice Homes will determine whether there has been a breach, and a breach will occur, whether or not we’ve given a notice of default.

h) If there is a lock-down of, or other restriction(s), imposed on the construction industry, or other such unforeseeable events beyond the control of New Choice Homes, preventing or delaying commencement of the works.

General

15) These terms and conditions are governed by the law of Western Australia.

16) 6 Month Start Time Guarantee Promotion end date: 30th of April 2023.

The Promise 2.0 – “10 Month Build Assurance”

These terms and conditions apply to the promotion by Essential First Choice Homes Pty Ltd (ACN 138 185 341) trading as New Choice Homes (New Choice Homes, us, we, our) known as the “10 Month Build Time Assurance”, under which New Choice Homes assures, represents or states to customers or potential customers (you or your) that a home built by New Choice Homes will be built within 10 months.

Build Time Assurance

  • Subject to these terms and conditions, New Choice Homes undertakes that practical completion of a home the subject of a signed Preparation of Plans Agreement will not be longer than 10 months (calculated as working days) after the first brick is laid on your home (as determined by New Choice Homes, acting reasonably) (Build Time Assurance).
  • These terms are important. You should read them.  These terms outline when the Build Time Assurance does not apply.  These terms also set out when New Choice Homes does not have to comply with the Build Time Assurance.

What contracts and homes does the Build Time Assurance apply to?
3) The Build Time Assurance only applies to the construction of a home that is the subject of a signed Preparation of Plans Agreement entered into between 10th November 2022 to the 31st of December 2023 (inclusive) (Offer Period), which is not terminated.
4) If you do not enter into a Preparation of Plans Agreement during the Offer Period, the Build Time Assurance does not apply. The Offer Period may be extended at New Choice Homes’ sole discretion.
5) The Build Time Assurance only applies to the following types of homes:
a) a single-storey home on a green title or survey strata lot;
b) duplex and triplex developments on a strata title lot (each home will be the subject of a separate contract);
c) a home that has a design from the New Choice Homes standard design range (up to a maximum of 300m2);
d) the home design does not materially vary from the standard New Choice Homes design (as determined by New Choice Homes); and
e) a home that is to be located in the Perth to Peel area between Dawesville in the south, Two Rocks in the north, Bullsbrook in the north-east (excluding Lower Chittering), and an area to the south-east as determined by New Choice Homes.
When will the Build Time Assurance not apply or cease to apply?
6) The Build Time Assurance does not apply in the following circumstances, and will cease to apply if any of the following occur after the relevant Preparation of Plans Agreement is signed:
a) If there is a material variation to the design or specifications of the home, or if the building contract is materially varied in any way which impacts the time for completion of the work (as determined by us). This means that if you change your mind about the build, specifications or design of the home in a way that impacts on the time for completion, we can no longer promise to complete the home within 10 months after the first brick is laid.
b) If you fail to provide any fixtures fittings or chattels which are required to be provided by you under the building contract at the time they are required to be provided for the works.
c) If there are any building or other works relating to the home which are arranged by you. This means the Build Time Assurance does not apply if you arrange your own subcontractors or trades to perform any works to be carried out at the same time as the building work by us or specify that we are to use any specific subcontractors or trades.
d) If the Preparation of Plans Agreement or building contract are terminated by any party.
7) In the event that one or more of the events listed in section 6 above occurs, New Choice Homes may decide that the Build Time Assurance continues to apply, on certain terms and in its sole discretion.
8) The Build Time Assurance will cease to apply if New Choice Homes determines that you have breached the terms of the Preparation of Plans Agreement or building contract. This would include failing to pay a progress payment or other amount when due. New Choice Homes will determine whether there has been a breach, and a breach will occur whether or not we’ve given a notice of default.
What happens if there are delays outside of New Choice Homes’ control?
9) The Build Time Assurance may be extended, at New Choice Homes’ election, if building works on the relevant home are delayed due to events or circumstances outside the reasonable control of New Choice Homes, so long as New Choice Homes taken reasonable steps to avoid that event or circumstance, including the matters listed below (Delay Event).
10) These types of events include the following:
a) breakdown of or accident to plant, machinery or equipment;
b) a shortage in the supply of labour, materials or delays in transport;
c) acts of vandalism, damage or theft in relation to the building;
d) any restrictions or interruption (including the availability of materials or labour) which is required or directed by a government agency imposed to deal with the family of viruses known as novel coronavirus COVID-19;
e) alterations to the building works;
f) any interference to the building works by any act or omission by you;
g) any delay caused by legal proceedings in respect of the property or building works or an order of a relevant authority;
h) any other matter that extends the time for practical completion under the relevant building contract;
i) an act of God, fire, explosion, earthquake, landslide, flood, washout, lightning, storm, tempest, or otherwise inclement weather;
j) strike, lockout, holidays granted in accordance with industrial laws, stoppage or restraint of labour or other industrial disturbance or dispute (whether lawful or unlawful);
k) war (declared or undeclared), act of public enemies, military action, insurrection, riot or civil commotion; or
l) expropriation by any governmental or military agency or authority, sabotage, restraints, embargoes or other acts by any governmental agency or authority.
11) If New Choice Homes determines that a Delay Event has occurred, New Choice Homes may by notice to you (at any time):
a) extend the end of the Build Time Assurance by a period that is equal to the expected delay caused by the Delay Event (as determined by New Choice Homes); or
b) cancel and terminate the Build Time Assurance.
Compensation
12) Subject to the above terms, if your home is not built to practical completion within 10 months from the date the first brick is laid, New Choice Homes will credit a weekly amount of $400 per week until the home is completed, up to a maximum of 5 weeks ($2,000 total).
13) The total amount of any such credit shall be deducted from the next progress claim amount payable to New Choice Homes under the Building Contract.
14) In the event of any claim for delay damages for late completion under the building contract, the amount credited in respect of the Build Time Assurance will be deducted from any delay damages otherwise payable.
15) The amount of $2,000 is the total amount of any liability (under contract, statute or otherwise) that New Choice Homes may have to you arising out of or in connection with the Build Time Assurance.
General
16) These terms and conditions are governed by the law of Western Australia.

These terms and conditions apply to the promotion by Essential First Choice Homes Pty Ltd (ACN 138 185 341) trading as New Choice Homes (New Choice Homes, us, we, our) known as the “15 Month Maintenance Period”, under which New Choice Homes assures, represents or states to customers or potential customers (you or your) that a home built by New Choice Homes will receive an extended maintenance period up to 15 months from the date of practical completion.
Extended Maintenance Period
1) Upon Practical Completion, the Client has the option to select either a 5-, 10- or 15-month Post Completion Maintenance Period (Maintenance Period). The selection must be notified to New Choice Homes in writing within 4 weeks of Practical Completion being reached. If no selection is made by the Client, then a 5-month Maintenance Period shall apply.
2) During the Maintenance Period, the Client may issue a notice to New Choice Homes on one occasion (only) of any items that the Client considers require maintenance, by completing the ‘Maintenance Notice Form’. The Maintenance Notice Form must be received by New Choice Homes either during the Maintenance Period or by no later than 2 weeks after the Maintenance Period has expired. If the Maintenance Notice is not received within this period, the Client waives any rights in respect of the Maintenance Period.
3) Upon receipt of the Maintenance Notice, New Choice Homes will arrange for an inspection to be undertaken of the items listed in the Maintenance Notice during business hours. The Client must make available all areas of the home for the inspection at the required time (Maintenance Inspection). Following the Maintenance Inspection, New Choice Homes shall undertake such works as it considers are required to attend to the items identified. The extent of the work to be undertaken (if any) is within the sole discretion of New Choice Homes. The Client must provide access during business hours as required for any works.
4) New Choice Homes shall not accept any responsibility for attending to items that result from misuse, wear and tear and/or damage to the home. The rights under the Maintenance Period are in addition to those rights in respect of the defects liability period in the Contract.
What contracts and homes does the 15 Month Maintenance Period apply to?
5) The 15 Month Maintenance Period only applies to the construction of a home that is the subject of a signed Preparation of Plans Agreement entered into between 10th November 2022 to the 31st of December 2023 (inclusive) (Offer Period), which is not terminated.
6) If you do not enter into a Preparation of Plans Agreement during the Offer Period, the 15 Month Maintenance Period does not apply. The Offer Period may be extended at New Choice Homes’ sole discretion.
7) Contracts and homes that have notified New Choice Homes of their selection to extend their maintenance period to either 10 months or 15 months.
When will the Build Time Assurance not apply or cease to apply?
8) The 15 Month Maintenance Period does not apply in the following circumstances, and will cease to apply if any of the following occur after the relevant Preparation of Plans Agreement is signed:
a. If you fail to provide in writing your selection extend the maintenance period by either 10 months or 15 months within 4 weeks of Practical Completion being reached.
b. If the Preparation of Plans Agreement or building contract are terminated by any party.
9) In the event that one or more of the events listed in section 8 above occurs, New Choice Homes may decide that the Build Time Assurance continues to apply, on certain terms and in its sole discretion.
The Build Time Assurance will cease to apply if New Choice Homes determines that you have breached the terms of the Preparation of Plans Agreement or building contract. This would include failing to pay a progress payment or other amount when due. New Choice Homes will determine whether there has been a breach, and a breach will occur whether or not we’ve given a notice of default.
General
10) These terms and conditions are governed by the law of Western Australia.

11) The Promise 2.0 – “15 Month Maintenance Period” end date: the 31st of December 2023

 

The Promise 2.0 – “Independent Building Inspector”

These terms and conditions apply to the promotion by Essential First Choice Homes Pty Ltd (ACN 138 185 341) trading as New Choice Homes (New Choice Homes, us, we, our) known as the “Independent Building Inspector”, under which New Choice Homes assures, represents or states to customers or potential customers (you or your) that a home built by New Choice Homes will have the option to have two independent building inspections carried out at no additional cost by Home Integrity Building Consultants.
To ensure your peace of mind that your new home has been constructed as required by the Contract and all applicable codes and standards, New Choice Homes offers to arrange and cover the costs of two (2) building inspections by ‘Home Integrity Building Consultants’.
This offer applies to a contract entered into for the construction of a New Choice Home between 10th November 2022 and 28th February 2023 and entitles the Client to elect to receive two (2) building inspections on the terms as set out below. Terms used in this offer are as per the Contract.
Home Integrity Building Consultants are an independent building inspection company (Home Integrity). Home Integrity will conduct up to two (2) independent inspections of your new home to assess the construction against the plans, specifications and applicable codes and standards.
First Inspection – Roof Frame
The first inspection will be performed at completion of the roof frame stage, and includes an extensive review of all elements relating to the home’s structural integrity, including inspections of: plumbing and electrical layouts; the visible slab; window and door frame locations and installation; brickwork; tie-down points and straps, and roof construction.
Second Inspection – Practical Completion
The second inspection will be performed when your home is at Practical Completion. The inspection will thoroughly review the final construction and finishes and Home Integrity’s building inspector will meet with you on-site and review and assess any additional items you may identify.
After the Inspection
The New Choice Homes site supervisor for the home will receive a copy of the report in order that they can attend to any issues identified.
Home Integrity will contact you by phone after each inspection to discuss the inspection report and provide you with an extensive checklist of the items covered. The building inspector can be contacted to assist with any concerns identified in the report.
On receipt of the report New Choice Homes shall undertake such works as it considers are required to be attended to in order to achieve Practical Completion and handover, and attend to any other items during the Defects Liability Period. The Client must provide reasonable access during business hours as required for any works attended to after handover.
Should you elect not to accept this offer, then you are of course free to choose an alternative building inspector (at your own expense).
What contracts and homes does the Independent Building Inspector promotion apply to?
1) The Independent Building Inspector promotion only applies to the construction of a home that is the subject of a signed Preparation of Plans Agreement entered into between 10th November 2022 to the 31st of December 2023 (inclusive) (Offer Period), which is not terminated.
2) If you do not enter into a Preparation of Plans Agreement during the Offer Period, the Independent Building Inspector promotion does not apply. The Offer Period may be extended at New Choice Homes’ sole discretion.
3) Contracts and homes that have notified New Choice Homes in writing of their wish to accept the offer to appoint Home Integrity as their independent building inspector.
When will the Independent Building Inspector promotion not apply or cease to apply?
4) The Independent Building Inspector promotion does not apply in the following circumstances, and will cease to apply if any of the following occur after the relevant Preparation of Plans Agreement is signed:
a. If you fail to provide in writing your wish to appoint Home Integrity as their independent building inspector.
b. If you notify New Choice Homes in writing that you do wish to appoint Home Integrity as your independent building inspector.
c. If the Preparation of Plans Agreement or building contract are terminated by any party.
5) In the event that one or more of the events listed in section 4 above occurs, New Choice Homes may decide that the Build Time Assurance continues to apply, on certain terms and in its sole discretion.
The Independent Building Inspector promotion will cease to apply if New Choice Homes determines that you have breached the terms of the Preparation of Plans Agreement or building contract. This would include failing to pay a progress payment or other amount when due. New Choice Homes will determine whether there has been a breach, and a breach will occur whether or not we’ve given a notice of default.

New Choice Homes – “10 Month Build Time Assurance” Promotion: Terms and Conditions

These terms and conditions apply to the promotion by Essential First Choice Homes Pty Ltd (ACN 138 185 341) trading as New Choice Homes (New Choice Homes, us, we, our) known as the “10 Month Build Time Assurance”, under which New Choice Homes assures, represents or states to customers or potential customers (you or your) that a home built by New Choice Homes will be built within 10 months.

The Build Time Assurance

  • Subject to these terms and conditions, New Choice Homes undertakes that practical completion of a home the subject of a signed Preparation of Plans Agreement will be no longer than 10 months after the first brick is laid on your home (as determined by New Choice Homes, acting reasonably) (Build Time Assurance).
  • These terms are important. You should read them.  These terms outline when the Build Time Assurance does not apply.  These terms also set out when New Choice Homes does not have to comply with the Build Time Assurance.

What contracts and homes does the Build Time Assurance apply to?

  • The Build Time Assurance only applies to the construction of a home that is the subject of a signed Preparation of Plans Agreement entered into between 14 March 2022 to 30 November 2022 (inclusive) (Offer Period), which is not terminated. If you do not enter into a Preparation of Plans Agreement during the Offer Period, the Build Time Assurance does not apply. The Offer Period may be extended at New Choice Homes’ sole discretion.
  • The Build Time Assurance only applies to the following types of homes:
    1. a single-storey home on a green title or survey strata lot;
    2. duplex and triplex developments on a strata title lot (each home will be the subject of a separate contract);
    3. a home that has a design from the New Choice Homes standard design range;
    4. the home design does not materially vary from the standard New Choice Homes design (as determined by New Choice Homes); and
    5. a home that is to be located in the Perth to Peel area between Dawesville in the south, Two Rocks in the north and an area to the east as determined by New Choice Homes.

When will the Build Time Assurance not apply or cease to apply?

  • The Build Time Assurance does not apply in the following circumstances, and will cease to apply if any of the following occur after the relevant Preparation of Plans Agreement is signed:
    1. If there is a variation to the design or specifications of the home, or if the building contract is varied in any way. In our discretion, we may decide in these circumstances that the Build Time Assurance continues to apply, on certain terms.  This means that if you change your mind about the build, specifications or design of the home, we can no longer promise to complete the home within 10 months after the first brick is laid.
    2. If you fail to provide any fixtures fittings or chattels which are required for the works at the time they are required.
    3. If there are any building or other works relating to the home which are arranged by you. This means the Build Time Assurance does not apply if you arrange your own subcontractors or trades to perform any works to be carried out at the same time as the building work by us or specify that we are to use any specific subcontractors or trades.
    4. If the Preparation of Plans Agreement or building contract are terminated by any party.
  • The Build Time Assurance will cease to apply if New Choice Homes determines that you have breached the terms of the Preparation of Plans Agreement or building contract. This would include failing to pay a progress payment or other amount when due.  New Choice Homes will determine whether there has been a breach, and a breach will occur whether or not we’ve given a notice of default.

What happens if there’s delays outside of New Choice Homes’ control?

  • The Build Time Assurance will be extended, at New Choice Homes’ election, if building works on the relevant home are delayed due to events or circumstances outside the reasonable control of New Choice Homes, so long as New Choice Homes taken reasonable steps to avoid that event or circumstance, including the matters listed below (Delay Event).
  • These types of events include the following:
    1. an act of God, fire, explosion, earthquake, landslide, flood, washout, lightning, storm, tempest, or otherwise inclement weather;
    2. strike, lockout, holidays granted in accordance with industrial laws, stoppage or restraint of labour or other industrial disturbance or dispute (whether lawful or unlawful);
    3. war (declared or undeclared), act of public enemies, military action, insurrection, riot or civil commotion;
    4. expropriation by any governmental or military agency or authority, sabotage, restraints, embargoes or other acts by any governmental agency or authority;
    5. breakdown of or accident to plant, machinery or equipment;
    6. a shortage in the supply of labour, materials or delays in transport;
    7. acts of vandalism, damage or theft in relation to the building;
    8. any restrictions or interruption (including the availability of materials or labour) which is required or directed by a government agency imposed to deal with the family of viruses known as novel coronavirus COVID-19;
    9. alterations to the building works;
    10. any interference to the building works by any act or omission by you; or
    11. any delay caused by legal proceedings in respect of the property or building works or an order of a relevant authority;
    12. any other matter that extends the time for practical completion under the relevant building contract.
  • If New Choice Homes determines that a Delay Event has occurred, New Choice Homes may by notice to you (at any time):
    1. extend the end of the Build Time Assurance by a period that is equal to the expected delay caused by the Delay Event (as determined by New Choice Homes); or
    2. cancel and terminate the Build Time Assurance.

Compensation

  • Subject to the above terms, if your home is not built to practical completion within 10 months from the date the first brick is laid, New Choice Homes will pay you a weekly amount of $400 until the home is completed, up to a maximum of 5 weeks. Those payments will be taken into account in respect of the payments to be made under the relevant home building contract.

2. The name of this Competition is the “Win Your Rent” competition (Competition).

3. This document, instructions on how to enter the Competition and any other details contained within promotional advertisements form part of the Terms and Conditions.

4. Participation in the Competition constitutes the entrant’s unconditional agreement to, and acceptance of, the Terms and Conditions.

5. To the maximum extent permitted by law, New Choice Homes’ decision is final and no correspondence will be entered into in relation to any dispute or other matter arising in relation to the Competition.

6. The Competition commences at [Friday 18th February 2022] and entries close and must be received by [Thursday 30th June 2022] (Competition Period).

Eligibility

7. Subject to clause 8, entry is open to Western Australian residents who:

(a) are aged at least 18 years old, primarily reside in rented accommodation under a residential tenancy agreement;

(b) have entered into a home building contract with New Choice Homes (in respect of  which formal unconditional finance approval has been received by New Choice Homes’ customer) and which is not terminated by the prize draw date, as specified in these Terms and Conditions;

(c) not have won a competition promoted by New Choice Homes in the previous 12 months; and

(d) elect to receive marketing and promotional materials from New Choice Homes.

8. Employees, contractors, suppliers and agents of New Choice Homes and their immediate family members are not eligible to enter the Competition and if such an entry is submitted, it will not be valid. A reference to an immediate family member refers to a person’s spouse, de facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, brother, sister, step-brother or step-sister, grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, stepsisters or first cousin.

To enter the Competition, Eligible Entrants must during the Competition Period  must scan the QR code entry and supply their name, contact phone number and email address (Eligible Entry).

9. An Eligible Entrant can only submit one Eligible Entry.

10. Any entry submitted by a person who does not satisfy the eligibility conditions detailed in the Terms and Conditions will not be valid.

11. An Eligible Entry is deemed to be received at the time it is received by New Choice Homes and not at the time of transmission by the Eligible Entrant.

12. A maximum of one Eligible Entry will be accepted from each Eligible Entrant.  The first Eligible Entry received by New Choice Homes from an Eligible Entrant will be considered the Eligible Entrant’s official entry. New Choice Homes reserves the right to disqualify entries where New Choice Homes considers, in its sole discretion, that the entry has been submitted from a fake user or a person who has already submitted an Eligible Entry.

13. New Choice Homes reserves the right to disqualify entries which are misleading, incomplete, indecipherable, illegal or offensive or otherwise in breach of these Terms and Conditions.

Prize

14. The prize will be the amount of an Eligible Entrant’s substantiated rental as at the date of the Eligible Entry (as determined by New Choice Homes for a 3 month period (Substantiated Amount) up to a maximum amount of $5,000 (or approximately $400 a week) (Prize).

15. There will be 1 Prize awarded to 1 Eligible Entrant who submitted an Eligible Entry selected at random.  The maximum total prize pool value is $5,000.

16. The Prize will be processed as a cash deposit into the winner’s nominated bank account only after:

(a) the winner has contacted New Choice Homes to accept the Prize within the time specified in these Terms and Conditions;

(b) the winner has provided New Choice Homes with bank account details and identification when accepting the Prize and had their identity verified by New Choice Homes;

(c) New Choice Homes is satisfied that the winner’s home building contract with New Choice Homes is current and has not terminated; and

(d) the winner has provided New Choice Homes with evidence to substantiate their current rental payments as at the date of the Eligible Entry (to the satisfaction of New Choice Homes).

17. If the Prize is unavailable for any reason, New Choice Homes may substitute a prize of equivalent value and the winner agrees to accept that substitute prize.

18. Any prize must be taken “as offered” and cannot be transferred, exchanged, varied or extended.

19. The winner will be randomly selected by a New Choice Homes staff member via a digital program at New Choice Home’s office at 24 Sangiorgio Court, Osborne Park  after 12:00pm AWST on [Thursday 7th July]. The winner will be notified via email or telephone within 48 hours of being drawn. New Choice Homes will require appropriate contact details and identification from the winner in order to provide the Prize.

20. New Choice Homes reserves the right to redraw the winner of the Prize if the winner is unable to satisfy these Terms and Conditions, forfeits or does not claim the Prize. The winner will forfeit the Prize if the winner does not respond within 10 business days accepting the Prize. If the winner forfeits or does not claim the Prize as at [Thursday 14th July], a further draw for the winner of the Prize will be conducted on [Friday 15th July] at the same place as the original draw and as otherwise provided for in these Terms and Conditions (subject to any applicable law). The winner of the further draw must respond to collect the Prize in compliance with these Terms and Conditions by [Friday 29th July].

21. To the maximum extent permitted by law, New Choice Homes’ decision regarding the Prize, determination of Eligible Entries and winners, and the conduct of the Competition is final and no correspondence will be entered into in relation to any dispute or other matter arising in relation to the Competition.

General

22. The Prize is issued by Essential First Choice Homes Pty Ltd (ACN 138 185 341) (Builders Registration No. BC13070). Please read the terms and conditions applicable to any home building contract before making any decision about our products and services.

23. By entering the Competition, all entrants authorise New Choice Homes to use the entry content for promotional, marketing, advertising and other business purposes without requiring any additional consent from the entrant and without compensating the entrant.

24. The winner agrees and consents to:

(a) participate and co-operate in any promotional activities relating to the Competition, including being interviewed and photographed; and

(b) New Choice Homes using the winner’s name, entry, likeness, image and voice (including photograph, film and recording of the same) in any media for an unlimited period of time without remuneration for the purpose of promoting the Competition (including any outcome), New Choice Homes and any products and services supplied by New Choice Homes.

25. By entering the Competition, entrants acknowledge and agree their entry data will be managed by New Choice Homes who take reasonable commercial steps to secure information in accordance with the Australian Privacy Principles under the Privacy Act 1988 (Cth). Entrants’ information will be stored in Australia for the duration of the competition and will be permanently deleted within a reasonable time. 26. Except for any liability that cannot be excluded by law, New Choice Homes (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Competition, including, but not limited to, where arising from the following:

(a) any technical difficulties or equipment malfunction (whether or not under the New Choice Homes’ control);

(b) any theft, unauthorised access or third party interference;

(c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by New Choice Homes ) due to any reason beyond the reasonable control of New Choice Homes;

(d) any variation in prize value to that stated in these Terms and Conditions;

(e) any tax liability incurred by a winner or entrant; or

(f) use of the Prize.

27. New Choice Homes reserves the right to:

(a) declare as void any entries or claims for prizes resulting from any printing, production or distribution errors or where there has been error in any aspect of the preparation for or conduct of the Competition materially affecting the result of the Competition or the number of winners or the value of claims for prizes;

(b) add to or to waive any of the Terms and Conditions;

(c) change the duration of the Competition; and

(d) cancel the Competition or any part of it at any stage in the event of circumstances beyond New Choice Homes’ control,

subject to the approval of the Gaming and Wagering Commission (WA) or other relevant authority (if and only to the extent required).

28. If the Competition is conducted on, or utilising, social media including, without limitation Facebook, Instagram and Twitter, the Competition shall be subject to the terms of use governing the applicable social media platform. In the event of an inconsistency between these Terms and Conditions, and the terms of use of the applicable social media platform, the terms of the applicable social media platform shall prevail.

29. Without prejudice to clause 28 above, if the Competition is conducted on a social media platform, entrants:

(a) fully release that social media platform from all liability arising out of the Competition;

(b) acknowledge that the Competition is in no way sponsored, endorsed or administered by, or associated with, that social media platform; and

(c) understand and accept that information disclosed in connection with the Competition is disclosed to New Choice Homes and not that social media platform.

30. The Competition is governed by, and these Terms and Conditions are to be interpreted in accordance with, the laws of Western Australia.

    (a)are aged at least 18 years old, primarily reside in rented accommodation under a residential tenancy agreement; and
    (b) elect to receive marketing and promotional materials from New Choice Homes.
    (Eligible Entrants).
  • Employees, contractors, suppliers and agents of New Choice Homes and their immediate family members are not eligible to enter the Competition and if such an entry is submitted, it will not be valid. A reference to an immediate family member refers to a person’s spouse, de facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, brother, sister, step-brother or step-sister, grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, stepsisters or first cousin.
  • To enter the Competition, Eligible Entrants must during the Competition Period must scan the QR code entry code and supply their name, contact phone number and email address (Eligible Entry).
  • An Eligible Entrant can only submit one Eligible Entry.
  • Any entry submitted by a person who does not satisfy the eligibility conditions detailed in the Terms and Conditions will not be valid.
  • An Eligible Entry is deemed to be received at the time it is received by New Choice Homes and not at the time of transmission by the Eligible Entrant.
  • A maximum of one Eligible Entry will be accepted from each Eligible Entrant. The first Eligible Entry received by New Choice Homes from an Eligible Entrant will be considered the Eligible Entrant’s official entry. New Choice Homes reserves the right to disqualify entries where New Choice Homes considers, in its sole discretion, that the entry has been submitted from a fake user or a person who has already submitted an Eligible Entry.
  • New Choice Homes reserves the right to disqualify entries which are misleading, incomplete, indecipherable, illegal or offensive or otherwise in breach of these Terms and Conditions.

Prize

  • The prize will be the amount of an Eligible Entrant’s substantiated rental as at the date of the Eligible Entry (as determined by New Choice Homes for a 3 month period (Substantiated Amount) up to a maximum amount of $5,000 (or approximately $400 a week) (Prize).
  • There will be 1 Prize awarded to 1 Eligible Entrant who submitted an Eligible Entry selected at random. The maximum total prize pool value is $5,000.
  • The Prize will be processed as a cash deposit into the winner’s nominated bank account only after:
    (a) the winner has contacted New Choice Homes to accept the Prize within the time specified in these Terms and Conditions;
    (b) the winner has provided New Choice Homes with bank account details and identification when accepting the Prize and had their identity verified by New Choice Homes; and
    (c) the winner has provided New Choice Homes with evidence to substantiate their current rental payments as at the date of the Eligible Entry (to the satisfaction of New Choice Homes).
    If the winner does not comply with this clause 16, the Prize will be forfeited.
  • If the Prize is unavailable for any reason, New Choice Homes may substitute a prize of equivalent value and the winner agrees to accept that substitute prize.
  • Any prize must be taken “as offered” and cannot be transferred, exchanged, varied or extended.
  • The winner will be randomly selected by a New Choice Homes staff member via a digital program at New Choice Home’s office at 24 Sangiorgio Court, Osborne Park after 12:00pm AWST on Wednesday, 22 December 2021. The winner will be notified via email or telephone within 48 hours of being drawn. New Choice Homes will require appropriate contact details and identification from the winner in order to provide the Prize.
  • New Choice Homes reserves the right to redraw the winner of the Prize if the winner is unable to satisfy these Terms and Conditions, forfeits or does not claim the Prize. The winner will forfeit the Prize if the winner does not respond within 10 business days accepting the Prize. If the winner forfeits or does not claim the Prize as at 12:00pm AWST on Wednesday, 5 January 2022, a further draw for the winner of the Prize will be conducted at 12:00pm AWST on Friday, 7 January 2022 at the same place as the original draw and as otherwise provided for in these Terms and Conditions (subject to any applicable law). The winner of the further draw must respond to collect the Prize in compliance with these Terms and Conditions by 12:00pm AWST on Monday, 17 January 2022.
    To the maximum extent permitted by law, New Choice Homes’ decision regarding the Prize, determination of Eligible Entries and winners, and the conduct of the Competition is final and no correspondence will be entered into in relation to any dispute or other matter arising in relation to the Competition.

General

  • The Prize is issued by Essential First Choice Homes Pty Ltd (ACN 138 185 341) (Builders Registration No. BC13070). Please read the terms and conditions applicable to any home building contract before making any decision about our products and services.
  • By entering the Competition, all entrants authorise New Choice Homes to use the entry content for promotional, marketing, advertising and other business purposes without requiring any additional consent from the entrant and without compensating the entrant.
  • The winner agrees and consents to:
    (a) participate and co-operate in any promotional activities relating to the Competition, including being interviewed and photographed; and
    (b) New Choice Homes using the winner’s name, entry, likeness, image and voice (including photograph, film and recording of the same) in any media for an unlimited period of time without remuneration for the purpose of promoting the Competition (including any outcome), New Choice Homes and any products and services supplied by New Choice Homes.
  • By entering the Competition, entrants acknowledge and agree their entry data will be managed by New Choice Homes who take reasonable commercial steps to secure information in accordance with the Australian Privacy Principles under the Privacy Act 1988 (Cth). Entrants’ information will be stored in Australia for the duration of the competition and will be permanently deleted within a reasonable time. The information will be used in accordance with New Choice Homes’ Privacy Policy available at https://www.newchoicehomes.com.au/privacy-policy/. Entrants must notify New Choice Homes if they would like to amend their personal information or if they have any queries as to how their personal information will be used.
  • Except for any liability that cannot be excluded by law, New Choice Homes (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Competition, including, but not limited to, where arising from the following:
    (a) any technical difficulties or equipment malfunction (whether or not under the New Choice Homes’ control);
    (b) any theft, unauthorised access or third party interference;
    (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by New Choice Homes ) due to any reason beyond the reasonable control of New Choice Homes;
    (d) any variation in prize value to that stated in these Terms and Conditions;
    (e) any tax liability incurred by a winner or entrant; or
    (f) use of the Prize.
  • New Choice Homes reserves the right to:
    (a) declare as void any entries or claims for prizes resulting from any printing, production or distribution errors or where there has been error in any aspect of the preparation for or conduct of the Competition materially affecting the result of the Competition or the number of winners or the value of claims for prizes;
    (b) add to or to waive any of the Terms and Conditions;
    (c) change the duration of the Competition; and
    (d) cancel the Competition or any part of it at any stage in the event of circumstances beyond New Choice Homes’ control,
    subject to the approval of the Gaming and Wagering Commission (WA) or other relevant authority (if and only to the extent required).
  • If the Competition is conducted on, or utilising, social media including, without limitation Facebook, Instagram and Twitter, the Competition shall be subject to the terms of use governing the applicable social media platform. In the event of an inconsistency between these Terms and Conditions, and the terms of use of the applicable social media platform, the terms of the applicable social media platform shall prevail.
  • Without prejudice to clause 28 above, if the Competition is conducted on a social media platform, entrants:
    (a) fully release that social media platform from all liability arising out of the Competition;
    (b) acknowledge that the Competition is in no way sponsored, endorsed or administered by, or associated with, that social media platform; and
    (c) understand and accept that information disclosed in connection with the Competition is disclosed to New Choice Homes and not that social media platform.
  • The Competition is governed by, and these Terms and Conditions are to be interpreted in accordance with, the laws of Western Australia.
  • The winner permits New Choice Homes to publish the winner’s name and photograph on their social media sites and website and any other marketing platforms for promotional purposes.

The Social Set Promotion

  • As part of ‘The Social Set’ promotion the client can choose from either the entertainer’s pack (2x Samsung TV’s, Sono’s Sound Bar in Black or White), Electronic Outdoor Heater, 3x Sonos Surround Sound Speakers, Bar Fridge and Ceiling Fan) Including installation of Fan & heater only or the designer elevation displayed on the social set flyers.

Refer A Friend Promotion

A referrer is the person who refers an individual to the company. The referrer will receive $1000 paid into their nominated bank account 30 days after the referred persons home has gone into construction and Slab has been laid.

To be eligible for the promotion the following terms and conditions must be met by the referrer

  • The referrer must give their full name and address and referring person’s full details on either New Choice Homes website or filling out our referral form.
