    These terms and conditions apply to the promotion by Essential First Choice Homes Pty Ltd (ACN 138 185 341) trading as New Choice Homes (New Choice Homes, us, we, our) known as the Turn Sunshine into Savings Promotion.

    • Turn Sunshine into Savings Promotion is available to new customers only and applies to the construction of a home that is the subject of a signed Preparation of Plans Agreement entered into between 1 November 2024 to 30 November 2024 (inclusive) (Offer Period), which is not terminated.
    • The Offer Period may be extended at New Choice Homes’ sole discretion.
    • Promotion is only applicable to Freedom and Signature home designs.
    • The promotion will only be provided where the customer has paid a full non-refundable deposit to New Choice Homes.
    • The customer must obtain unconditional formal finance approval.
    • At time of authorised Preparation of Plans Agreement, Annexure 8 Turn Sunshine into Savings Promotion must be signed by the customer to acknowledge the inclusion of:
      • 6.6kW (15 panel) system with 5000watt standard inverter to suite single phase electricity supply.
      • $8k to spend your way to be used as a discount off the total contract price, prestart allowance or
        give-away inclusions.
    • Total number of solar panels subject to roof size to be determined by builder. Up to a maximum of 15 panels..
    • Items can be upgraded at the cost to the customer.
    • Items in this promotion cannot be redeemed or sold for cash.
    • Standard single-phase power is included in this offer. Customers may upgrade to three-phase power for an additional fee at the customers’ expense.
    • No allowance included in this offer for any modifications. All modifications will be an additional fee at the customers’ expense.
    • No rebates are applicable with the offer, including any third-party rebate offers.
    • $8,000.00 to spend your way to be shown as a credit on the Sales Costing forming part of the signed Preparation of Plans Agreement.
    • Should the customer decline Turn Sunshine into Savings Promotion at time of authorised Preparation of Plans Agreement, the Sales Consultant may offer Annexure K $10k Choose More Promotion in lieu of the Turn Sunshine into Savings Promotion. Annexure K must be signed outlining the offer and terms of the $10k Choose More Promotion. On selection of this option the customer will forfeit the upgraded 6.6kW (15 modules) system with 5000watt standard inverter and receive the standard 3.3kW solar PV system with standard inverter as included in New Choice Homes Freedom and Signature specification.
    • New Choice Homes Open Book Promise may be offered and subject to individual T&Cs. These individual terms will be detailed in separate annexures for each offer, which must be signed to form part of the complete agreement. These terms are important and should be read in full.
    • No other discount or promotion will be offered or included during the Turn Sunshine into Savings Promotion offer period.

    The Builder ‘New Choice Homes’ takes no responsibility for any item that is outside of the builder control not limited to the following:

    • The Customers ability to obtain finance
    • Delivery date delays from the supplier
    • Installation delays from the supplier’s contractors
    • Cost to upgrade to three-phase power
    • Customers are responsible for the service and maintenance as per manufacturer’s warranty.

    Turn Sunshine into Savings print and social advertising disclaimer:
    Estimation only of maximum savings over the period stated. Assumptions – Based on a North facing solar power system in optimum conditions and assumes full year-round utilisation of generated electricity with 100% self-consumption and zero export to the grid. Dollar savings are potential maximums and are based on an average daily solar production as per Clean Energy Council Solar PV Consumer Guide Vol17 21 May 2012 and Synergy A1 tariff of 26.46cents per kWh. Percentage savings are potential maximums and are based on a household average annual consumption of 20kWh per day for a 4 person Perth household as per Australian Energy Regulator Energy Made Easy website. System efficiency is estimated only and does not take into account for losses that may include shading, inverter efficiency, cable losses, dirt, manufacturer tolerances, grid outages, maintenance downtime, and other factors.   • $10K BUILDING BONUS PROMOTION | 2024
    • Promotion is only applicable to the Essentials, Freedom, Signature, Select, Individual and Developments range home designs.
    • The promotion will only be provided where the client has authorised a Preparations of Plans Agreement, enters into a Building Contract with New Choice Homes and proceeds to the practical completion of the home.
    • Client has paid a full non-refundable deposit to New Choice Homes.
    • Client must obtain unconditional finance approval and loan documentation must be signed.
    • $10,000 rebate will be credited off the total quoted price and will be applied upon the signing of the Preparations of Plans Agreement.
    • The Promotion is to be added in the Sales Costing that forms part of the signed Preparation of Plans Agreement.
    • This promotion cannot be redeemed or sold for cash.
    • The promotion is available for a limited time and New Choice Homes reserves the right to amend the terms and duration of the offer.
    • This promotion excludes any other offers, discounts or promotions currently included in the home designs as outlined above .
    • Promotion is not applicable to the Essentials X home designs.
    • If clients want to add any items additional charges will apply. Promotion Annexure/s applicable to the month of sale must be completed and signed by the client. The item must be added to the sales costing or sales variation that forms part of the signed Preparations of Plans Agreement.
  • ULTIMATE VALUE PROMOTION | JULY-SEPTEMBER 2024
    • The Ultimate Value promotion only applies to the Zeus, the Apollo and the Winston designs in the Freedom specification.
    • Minor design changes are permitted to the floor plans within reason, major structural changes where the design has been recreated will not be accepted.
    • The Ultimate Value promotion applies to the construction of a new home that is the subject of a signed Preparation of Plans Agreement (PPA) entered into between the client and New Choice Homes between 1st July 2024 to 31st August 2024 (inclusive) (Offer Period), which is not terminated.
    • The from price does not include the $1,990 upgrade offer
    • As part of the Ultimate Value Promotion July 2024 the client must select one of two options:
    1. Apply the cost of $1,990 to include the Ultimate Value Upgrade inclusions of:

    • The Clients ability to obtain finance.

    • Client are responsible for the cost to supply and maintain WIFI to the home
    • Clients are responsible for the cleaning and maintenance of appliances as per manufacturer’s warranty.
  • OPEN BOOK PROMISE | 2024

    6 MONTH PRICE HOLD –  1ST MAY 2024

    These terms and conditions apply to the promotion by Essential First Choice Homes Pty Ltd (ACN 138 185 341) trading as New Choice Homes (New Choice Homes, us, we, our) known as the Open Book Promise “6 Month Price Hold”, under which New Choice Homes assures, represents or states to customers or potential customers (you or your) that a six (6) month price hold is on offer to all new customers who entered into a PPA agreement from the 1/05/2024 to the 31/01/2025.  This offer is subject to change at any time and will be reviewed for extension on the 31/01/2025.

    • Subject to these terms and conditions, New Choice Homes undertakes that no price increases will be passed onto customers during the six-month price hold period. Upon the expiry of the six-month period, should we have not yet commenced on site a price increase may be passed onto the customer.
    • These terms are important. You should read them. These terms outline when the 6 Month Price Hold does and does not apply.

    The 6 Month Price Hold timing will commence from the date which the Preparation of Plans Agreement has been signed and will run for a period of 6 calendar months or the equivalent to 24 weeks which includes weekends and public holidays.

    The 6 Month Price Hold is applicable to the base price and sale variations only and excludes all provisional sums.

    New Choice Homes will hold the price for the 6-month period subject to the following terms and conditions being met by the purchaser(s).

    • The purchaser(s) signs this 6 Month Price Hold Annexure at the same time as signing their Preparation of Plans Agreement.
    • Building contracts are signed by the purchaser(s) within ten (10) working days of them being issued.
    • The purchaser(s) must book their prestart meeting no later than three (3) working days of receiving a welcome letter from their assigned
    • Prestart Consultant.
    • The prestart meeting must occur no later than four (4) calendar weeks from when the Prestart Consultant contacts the purchaser(s).
    • One (1) prestart meeting is permitted to be conducted.
    • Purchaser(s) meetings with external suppliers must be conducted within five (5) working days from the date the prestart meeting was
    • All prestart variations are to be signed off within three (3) working days of being received.
    • Final Documentation (being the final set of working drawings and final addenda) is signed off by the purchaser(s) within five (5) working days
    • from being issued.
    • No prestart variations are to be raised after the Final Documentation has been issued
    • All revisions and variations to the building contract and associated documentation are signed by the purchaser(s) within three (3) working days
    • from being issued.
    • The purchaser(s) acknowledge that revisions and variations to the contract contribute to delays, and the time taken to work through the revision
    • and/or variation is time used within the 6 Month Price Hold period. No additional time will be provided.
    • Providing New Choice Homes has commenced construction within 6 months from signing the Preparation of Plans Agreement and the above
    • terms and conditions have been met, then the 6 Month Price Hold will be honoured.
    • New Choice Homes takes no responsibility for any delays caused outside the Builders control including but not limited to the following;
    • Titling of land by the developer
    • The purchaser(s) ability to obtain finance approval
    • Finance delays either by the lender or purchaser(s)
    • Planning approvals
    • Shire approvals
    • Developer approvals
    • Delays caused by external suppliers
    • Delays caused due to the 6-Month Price Hold terms and conditions being breached

    New Choice Homes reserves the right to review the conditions of this promotion at any time. Should a review be required after the lumpsum building contract has been executed then the conditions within the building contract apply.

    What happens if New Choice Homes are not on site within 6 months from signing the Preparation of Plan Agreement?

    If the delay has been caused solely by the purchaser or the terms and conditions of the 6 Month Price Hold Annexure have been breached, a price review may be conducted and a price increase may be passed onto the purchaser(s).

    What happens if at the time of signing the Preparation of Plans Agreement it is known that New Choice Homes will not be able to commence on site within the 6 months?

    Your New Choice Homes Sales Consultant will provide a Delayed Commencement Allowance within your costings based on the amount of additional months required beyond the 6 month period. It is important that this is discussed with your Sales Consultant.

    Are delayed titles classified as a delay solely caused by the purchaser?

    As the purchaser(s) has entered into a separate agreement with a seller or land developer, yes this delay is classified as a delay solely by the purchaser.

    Are delays in obtaining unconditional finance approval classified as a delay solely by the purchaser?

    As its the purchaser(s) obligation to obtain unconditional finance approval, yes this delay is classified as a delay solely by the purchaser.

     

    12 Month Build Time Assurance –  Promotion start date 1st January 2024

    These terms and conditions apply to the promotion by Essential First Choice Homes Pty Ltd (ACN 138 185 341) trading as New Choice Homes (New Choice Homes, us, we, our) known as the “12 Month Build Time Assurance”, under which New Choice Homes assures, represents or states to customers or potential customers (you or your) that a home built by New Choice Homes will be built within 12 calendar months.

    Build Time Assurance

    • Subject to these terms and conditions, New Choice Homes undertakes that practical completion of a home the subject of a signed Preparation of Plans Agreement will not be longer than 12 months (calculated as 12 calendar months eg. 1stJanuary 2024 to 1st January 2025) after the first brick is laid on your home (as determined by New Choice Homes, acting reasonably) (Build Time Assurance).
    • These terms are important. You should read them.  These terms outline when the Build Time Assurance does not apply.  These terms also set out when New Choice Homes does not have to comply with the Build Time Assurance.

    What contracts and homes does the Build Time Assurance apply to?

    • The Build Time Assurance only applies to the construction of a home that is the subject of a signed Preparation of Plans Agreement entered into between 1stJanuary 2023 to the 31st January 2025 (inclusive) (Offer Period), which is not terminated.
    • If you do not enter into a Preparation of Plans Agreement during the Offer Period, the Build Time Assurance does not apply. The Offer Period may be extended at New Choice Homes’ sole discretion.

    The Build Time Assurance only applies to the following types of homes:

    1. a) a single-storey home on a green title or survey strata lot;
      b) duplex and triplex developments on a strata title lot (each home will be the subject of a separate contract);
      c) a home that has a design from the New Choice Homes standard design range (up to a maximum of 300m2);
      d) the home design does not materially vary from the standard New Choice Homes design (as determined by New Choice Homes); and
      e) a home that is to be located in the Perth to Peel area between Dawesville in the south, Two Rocks in the north, Bullsbrook in the north-east (excluding Lower Chittering), and an area to the south-east as determined by New Choice Homes.

    When will the Build Time Assurance not apply or cease to apply?

    6) The Build Time Assurance does not apply in the following circumstances, and will cease to apply if any of the following occur after the relevant Preparation of Plans Agreement is signed:

    1. a) If there is a material variation to the design or specifications of the home, or if the building contract is materially varied in any way which impacts the time for completion of the work (as determined by us). This means that if you change your mind about the build, specifications or design of the home in a way that impacts on the time for completion, we can no longer promise to complete the home within 12 months after the first brick is laid.
    2. b) If you fail to provide any fixtures fittings or chattels which are required to be provided by you under the building contract at the time they are required to be provided for the works.
    3. c) If there are any building or other works relating to the home which are arranged by you. This means the Build Time Assurance does not apply if you arrange your own subcontractors or trades to perform any works to be carried out at the same time as the building work by us or specify that we are to use any specific subcontractors or trades.
      d) If the Preparation of Plans Agreement or building contract are terminated by any party.

    7) In the event that one or more of the events listed in section 6 above occurs, New Choice Homes may decide that the Build Time Assurance continues to apply, on certain terms and in its sole discretion.

    8) The Build Time Assurance will cease to apply if New Choice Homes determines that you have breached the terms of the Preparation of Plans Agreement or building contract. This would include failing to pay a progress payment or other amount when due. New Choice Homes will determine whether there has been a breach, and a breach will occur whether or not we’ve given a notice of default.

    What happens if there are delays outside of New Choice Homes’ control?

    9) The Build Time Assurance may be extended, at New Choice Homes’ election, if building works on the relevant home are delayed due to events or circumstances outside the reasonable control of New Choice Homes, so long as New Choice Homes taken reasonable steps to avoid that event or circumstance, including the matters listed below (Delay Event).

    10) These types of events include the following:

    1. a) breakdown of or accident to plant, machinery or equipment;
      b) a shortage in the supply of labour, materials or delays in transport;
      c) acts of vandalism, damage or theft in relation to the building;
      d) any restrictions or interruption (including the availability of materials or labour) which is required or directed by a government agency imposed to deal with the family of viruses known as novel coronavirus COVID-19;
      e) alterations to the building works;
      f) any interference to the building works by any act or omission by you;
      g) any delay caused by legal proceedings in respect of the property or building works or an order of a relevant authority;
      h) any other matter that extends the time for practical completion under the relevant building contract;
      i) an act of God, fire, explosion, earthquake, landslide, flood, washout, lightning, storm, tempest, or otherwise inclement weather;
      j) strike, lockout, holidays granted in accordance with industrial laws, stoppage or restraint of labour or other industrial disturbance or dispute (whether lawful or unlawful);
      k) war (declared or undeclared), act of public enemies, military action, insurrection, riot or civil commotion; or
      l) expropriation by any governmental or military agency or authority, sabotage, restraints, embargoes or other acts by any governmental agency or authority.
      11) If New Choice Homes determines that a Delay Event has occurred, New Choice Homes may by notice to you (at any time):
      a) extend the end of the Build Time Assurance by a period that is equal to the expected delay caused by the Delay Event (as determined by New Choice Homes); or
      b) cancel and terminate the Build Time Assurance.

    Compensation

    12) Subject to the above terms, if your home is not built to practical completion within 12 months from the date the first brick is laid, New Choice Homes will credit a weekly amount of $400 per week until the home is completed, up to a maximum of 5 weeks ($2,000 total).

    13) The total amount of any such credit shall be deducted from the next progress claim amount payable to New Choice Homes under the Building Contract.

    14) In the event of any claim for delay damages for late completion under the building contract, the amount credited in respect of the Build Time Assurance will be deducted from any delay damages otherwise payable.

    15) The amount of $2,000 is the total amount of any liability (under contract, statute or otherwise) that New Choice Homes may have to you arising out of or in connection with the Build Time Assurance.

    General
    16) These terms and conditions are governed by the law of Western Australia.

    17) The 12 Month Build Assurance” end date: 31st of January 2025.

     

    INDEPENDENT BUILDING INSPECTOR OFFER – 1ST JANUARY 2024

    These terms and conditions apply to the promotion by Essential First Choice Homes Pty Ltd (ACN 138 185 341) trading as New Choice Homes (New Choice Homes, us, we, our) known as the “Independent Building Inspector”, under which New Choice Homes assures, represents or states to customers or potential customers (you or your) that a home built by New Choice Homes will have the option to have two independent building inspections carried out at no additional cost by Home Integrity Building Consultants.

    To ensure your peace of mind that your new home has been constructed as required by the Contract and all applicable codes and standards, New Choice Homes offers to arrange and cover the costs of two (2) building inspections by ‘Home Integrity Building Consultants’.

    Home Integrity Building Consultants are an independent building inspection company (Home Integrity). Home Integrity will conduct up to two (2) independent inspections of your new home to assess the construction against the plans, specifications and applicable codes and standards.

    First Inspection – Roof Frame
    The first inspection will be performed at completion of the roof frame stage, and includes an extensive review of all elements relating to the home’s structural integrity, including inspections of: plumbing and electrical layouts; the visible slab; window and door frame locations and installation; brickwork; tie-down points and straps, and roof construction.

    The second inspection will be performed when your home is at Practical Completion. The inspection will thoroughly review the final construction and finishes and Home Integrity’s building inspector will meet with you on-site and review and assess any additional items you may identify.

    After the Inspection
    The New Choice Homes site supervisor for the home will receive a copy of the report in order that they can attend to any issues identified.
    Home Integrity will contact you by phone after each inspection to discuss the inspection report and provide you with an extensive checklist of the items covered. The building inspector can be contacted to assist with any concerns identified in the report.
    On receipt of the report New Choice Homes shall undertake such works as it considers are required to be attended to in order to achieve Practical Completion and handover, and attend to any other items during the Defects Liability Period. The Client must provide reasonable access during business hours as required for any works attended to after handover.
    Should you elect not to accept this offer, then you are of course free to choose an alternative building inspector (at your own expense).

    What contracts and homes does the Independent Building Inspector Offer apply to?
    1) The Independent Building Inspector Offer only applies to the construction of a home that is the subject of a signed Preparation of Plans Agreement entered into between 1st January 2023 to the 31st of January 2025. (inclusive) (Offer Period), which is not terminated.

    2) If you do not enter into a Preparation of Plans Agreement during the Offer Period, the Independent Building Inspector Offer does not apply. The Offer Period may be extended at New Choice Homes’ sole discretion.

    3) Contracts and homes that have notified New Choice Homes in writing of their wish to accept the offer to appoint Home Integrity as their independent building inspector.
    When will the Independent Building Inspector Offer (Jan 2024) not apply or cease to apply?
    4) The Independent Building Inspector Offer does not apply in the following circumstances, and will cease to apply if any of the following occur after the relevant Preparation of Plans Agreement is signed:

    1. If you fail to provide in writing your wish to appoint Home Integrity as their independent building inspector.
      b. If you notify New Choice Homes in writing that you do wish to appoint Home Integrity as your independent building inspector.
      c. If the Preparation of Plans Agreement or building contract are terminated by any party.

    5) In the event that one or more of the events listed in section 4 above occurs, New Choice Homes may decide that the Independent Building Inspector Offer continues to apply, on certain terms and in its sole discretion.

    The Independent Building Inspector Offer will cease to apply if New Choice Homes determines that you have breached the terms of the Preparation of Plans Agreement or building contract. This would include failing to pay a progress payment or other amount when due. New Choice Homes will determine whether there has been a breach, and a breach will occur whether or not we’ve given a notice of default.

    General
    6) These terms and conditions are governed by the law of Western Australia.

    7) The “Independent Building Inspector Offer” end date: 31st of January 2025.

     

    12 MONTHS MAINTENANCE PERIOD

    As offered under New Choice Homes Freedom and Essential Specifications.

    LIFETIME STRUCTURAL GUARANTEE

    • Warranty is valid for 25 Years from the practical completion date, for any structural defects which may arise within the statutory period and thereafter to a maximum of 25 Years.
    • New Choice Homes provide a Structural Warranty to the original homeowner of the said property and is not transferrable whatsoever. Once transferred to a new owner the home shall revert to the statutory 6-year Warranty as per current legislation.
    • The Builder shall not be liable to remedy any damage or rectify any defects to the works arising from any work carried out on the site caused by storm, fire, flood, any form of natural disasters, acts of terrorism or abuse.
    • Regular maintenance will prevent issues arising as a result of neglect, as these are not covered by this warranty.
    • The terms of the Lifetime Structural Guarantee are governed under Western Australian law.

    Promotion start date 1st January 2024

    These terms and conditions apply to the promotion by Essential First Choice Homes Pty Ltd (ACN 138 185 341) trading as New Choice Homes (New Choice Homes, us, we, our) known as the “12 Month Build Time Assurance”, under which New Choice Homes assures, represents or states to customers or potential customers (you or your) that a home built by New Choice Homes will be built within 12 calendar months.

    Build Time Assurance

    • Subject to these terms and conditions, New Choice Homes undertakes that practical completion of a home the subject of a signed Preparation of Plans Agreement will not be longer than 12 months (calculated as 12 calendar months eg. 1st January 2024 to 1st January 2025) after the first brick is laid on your home (as determined by New Choice Homes, acting reasonably) (Build Time Assurance).
    • These terms are important. You should read them.  These terms outline when the Build Time Assurance does not apply.  These terms also set out when New Choice Homes does not have to comply with the Build Time Assurance.

    What contracts and homes does the Build Time Assurance apply to?
    3) The Build Time Assurance only applies to the construction of a home that is the subject of a signed Preparation of Plans Agreement entered into between 1st January 2023 to the 31st January 2025 (inclusive) (Offer Period), which is not terminated.
    4) If you do not enter into a Preparation of Plans Agreement during the Offer Period, the Build Time Assurance does not apply. The Offer Period may be extended at New Choice Homes’ sole discretion.
    5) The Build Time Assurance only applies to the following types of homes:
    a) a single-storey home on a green title or survey strata lot;
    b) duplex and triplex developments on a strata title lot (each home will be the subject of a separate contract);
    c) a home that has a design from the New Choice Homes standard design range (up to a maximum of 300m2);
    d) the home design does not materially vary from the standard New Choice Homes design (as determined by New Choice Homes); and
    e) a home that is to be located in the Perth to Peel area between Dawesville in the south, Two Rocks in the north, Bullsbrook in the north-east (excluding Lower Chittering), and an area to the south-east as determined by New Choice Homes.
    When will the Build Time Assurance not apply or cease to apply?
    6) The Build Time Assurance does not apply in the following circumstances, and will cease to apply if any of the following occur after the relevant Preparation of Plans Agreement is signed:
    a) If there is a material variation to the design or specifications of the home, or if the building contract is materially varied in any way which impacts the time for completion of the work (as determined by us). This means that if you change your mind about the build, specifications or design of the home in a way that impacts on the time for completion, we can no longer promise to complete the home within 12 months after the first brick is laid.
    b) If you fail to provide any fixtures fittings or chattels which are required to be provided by you under the building contract at the time they are required to be provided for the works.
    c) If there are any building or other works relating to the home which are arranged by you. This means the Build Time Assurance does not apply if you arrange your own subcontractors or trades to perform any works to be carried out at the same time as the building work by us or specify that we are to use any specific subcontractors or trades.
    d) If the Preparation of Plans Agreement or building contract are terminated by any party.
    7) In the event that one or more of the events listed in section 6 above occurs, New Choice Homes may decide that the Build Time Assurance continues to apply, on certain terms and in its sole discretion.
    8) The Build Time Assurance will cease to apply if New Choice Homes determines that you have breached the terms of the Preparation of Plans Agreement or building contract. This would include failing to pay a progress payment or other amount when due. New Choice Homes will determine whether there has been a breach, and a breach will occur whether or not we’ve given a notice of default.
    What happens if there are delays outside of New Choice Homes’ control?
    9) The Build Time Assurance may be extended, at New Choice Homes’ election, if building works on the relevant home are delayed due to events or circumstances outside the reasonable control of New Choice Homes, so long as New Choice Homes taken reasonable steps to avoid that event or circumstance, including the matters listed below (Delay Event).
    10) These types of events include the following:
    a) breakdown of or accident to plant, machinery or equipment;
    b) a shortage in the supply of labour, materials or delays in transport;
    c) acts of vandalism, damage or theft in relation to the building;
    d) any restrictions or interruption (including the availability of materials or labour) which is required or directed by a government agency imposed to deal with the family of viruses known as novel coronavirus COVID-19;
    e) alterations to the building works;
    f) any interference to the building works by any act or omission by you;
    g) any delay caused by legal proceedings in respect of the property or building works or an order of a relevant authority;
    h) any other matter that extends the time for practical completion under the relevant building contract;
    i) an act of God, fire, explosion, earthquake, landslide, flood, washout, lightning, storm, tempest, or otherwise inclement weather;
    j) strike, lockout, holidays granted in accordance with industrial laws, stoppage or restraint of labour or other industrial disturbance or dispute (whether lawful or unlawful);
    k) war (declared or undeclared), act of public enemies, military action, insurrection, riot or civil commotion; or
    l) expropriation by any governmental or military agency or authority, sabotage, restraints, embargoes or other acts by any governmental agency or authority.
    11) If New Choice Homes determines that a Delay Event has occurred, New Choice Homes may by notice to you (at any time):
    a) extend the end of the Build Time Assurance by a period that is equal to the expected delay caused by the Delay Event (as determined by New Choice Homes); or
    b) cancel and terminate the Build Time Assurance.
    Compensation
    12) Subject to the above terms, if your home is not built to practical completion within 12 months from the date the first brick is laid, New Choice Homes will credit a weekly amount of $400 per week until the home is completed, up to a maximum of 5 weeks ($2,000 total).
    13) The total amount of any such credit shall be deducted from the next progress claim amount payable to New Choice Homes under the Building Contract.
    14) In the event of any claim for delay damages for late completion under the building contract, the amount credited in respect of the Build Time Assurance will be deducted from any delay damages otherwise payable.
    15) The amount of $2,000 is the total amount of any liability (under contract, statute or otherwise) that New Choice Homes may have to you arising out of or in connection with the Build Time Assurance.

    • Regular maintenance will prevent issues arising as a result of neglect, as these are not covered by this warranty.

    These terms and conditions apply to the promotion by Essential First Choice Homes Pty Ltd (ACN 138 185 341) trading as New Choice Homes (New Choice Homes, us, we, our) known as the Designer Kitchen Package.

    • The Designer Kitchen Package only applies to the construction of a home that is the subject of a signed Preparation of Plans Agreement entered into between 1 February 2023 to 31 March 2023 (inclusive) (Offer Period), which is not terminated.   • THE PROMISE 2.0 | 2023

    The Promise 2.0 – “6 Month Start Time Guarantee”

    These terms and conditions apply to the promotion by Essential First Choice Homes Pty Ltd (ACN 138 185 341) trading as New Choice Homes (New Choice Homes, us, we, our) known as the “6 Month Start Time Guarantee”, under which New Choice Homes assures, represents or states to customers or potential customers (you or your) that work on the construction of your new home will commence within 6 months of the Certificate of Acceptance.

    1) Subject to these terms and conditions, New Choice Homes undertakes that the new home build will commence within 6 months of the Certificate of Acceptance (6 Month Start Time Guarantee).

    2) These terms are important. You should read them. These terms outline when the 6 Month Start Time Guarantee does and does not apply.

    6 Month Start Time Guarantee

    3) New Choice Homes guarantees that the earthworks will be started within 6 months from the date on the ‘Certificate of Acceptance.’

    4) If New Choice Homes does not comply with the 6 Month Start Time Guarantee it will credit to you a weekly amount of $400 for up to a maximum of 5 weeks (total amount capped at $2,000).

    5) The number of weeks delay (if any) shall be calculated by New Choice Homes, based on the period of any delay in laying the slab, beyond the 6 month period from the Certificate of Acceptance.

    6) The total amount of any such credit shall be deducted from the next progress claim amount payable to New Choice Homes under the Building Contract.

    7) The amount of $2,000 is the total amount of any liability (under contract, statute or otherwise) that New Choice Homes may have to you arising out of or in connection with the 6 Month Start Time Guarantee.

    When does the 6 Month Start Time Guarantee apply to?

    8) The 6 Month Start Time Guarantee only applies to the construction of a new home that is the subject of a signed Building Contract entered into between You and New Choice Homes between 10th November 2022 and 28th February 2023 (inclusive) (Offer Period), which is not terminated.

    9) If you do not enter into a Building Contract during the Offer Period, the 6 Month Start Time Guarantee does not apply. The Offer Period may be extended at New Choice Homes’ sole discretion.

    10) The 6 Month Start Time Guarantee only applies to a new single-storey home from the New Choice Homes standard design range which does not materially vary from the standard design (as determined by New Choice Homes).

    11) To qualify for, and for the 6 Month Start Time Guarantee to apply, you must have a ‘Certificate of Acceptance’ issued by New Choice Homes. The Certificate of Acceptance will be issued once the deposit has been paid in full and the following documents have been submitted and accepted by New Choice Homes:

    a) a signed Quotation acceptance;

    b) an executed Preparation of Plans Agreement;

    c) a signed sketch; and

    d) an executed offer and acceptance.

    12) The 6 Month Start Time Guarantee only applies where the prestart process is completed within 20 Working Days of entering the Building Contract.

    13) The above requirements may be waived in whole or part at New Choice Homes’ sole discretion.

    When will the 6 Month Start Time Guarantee not apply?

    14) The 6 Month Start Time Guarantee does not apply in the following circumstances, and is subject to the sole discretion of New Choice Homes:

    a) If there is a material variation to the design or specifications of the home;

    b) If the Prestart process is not completed within 20 working days. This means that if you change your mind about the build, specifications or design of the home, we can no longer promise to maintain the 6 Month Start Time Guarantee of your new home build.

    c) If the work on Site is delayed by any inability on the part of the owner to obtain finance;

    d) If the work on Site is delayed by any issues related to the issuing of the title or any denial of access to the site (however caused);

    e) If there are any building or other works relating to the home which are arranged by you. This means the 6 Month Start Time Guarantee does not apply if you arrange your own subcontractors or trades to perform any works to be carried out at the same time as, or prior to, the building work by New Choice Homes or specify that we are to use any specific subcontractors or trades.

    f) If the Preparation of Plans Agreement or Building Contract are terminated by any party.

    g) If New Choice Homes determines that you have breached the terms of the Preparation of Plans Agreement or Building Contract. New Choice Homes will determine whether there has been a breach, and a breach will occur, whether or not we’ve given a notice of default.

    h) If there is a lock-down of, or other restriction(s), imposed on the construction industry, or other such unforeseeable events beyond the control of New Choice Homes, preventing or delaying commencement of the works.

    General

    15) These terms and conditions are governed by the law of Western Australia.

    16) 6 Month Start Time Guarantee Promotion end date: 30th of April 2023.

    The Promise 2.0 – “10 Month Build Assurance”

    These terms and conditions apply to the promotion by Essential First Choice Homes Pty Ltd (ACN 138 185 341) trading as New Choice Homes (New Choice Homes, us, we, our) known as the “10 Month Build Time Assurance”, under which New Choice Homes assures, represents or states to customers or potential customers (you or your) that a home built by New Choice Homes will be built within 10 months.

    Build Time Assurance

    • Subject to these terms and conditions, New Choice Homes undertakes that practical completion of a home the subject of a signed Preparation of Plans Agreement will not be longer than 10 months (calculated as working days) after the first brick is laid on your home (as determined by New Choice Homes, acting reasonably) (Build Time Assurance).
    • These terms are important. You should read them.  These terms outline when the Build Time Assurance does not apply.  These terms also set out when New Choice Homes does not have to comply with the Build Time Assurance.

    What contracts and homes does the Build Time Assurance apply to?
    3) The Build Time Assurance only applies to the construction of a home that is the subject of a signed Preparation of Plans Agreement entered into between 10th November 2022 to the 31st of December 2023 (inclusive) (Offer Period), which is not terminated.
    4) If you do not enter into a Preparation of Plans Agreement during the Offer Period, the Build Time Assurance does not apply. The Offer Period may be extended at New Choice Homes’ sole discretion.
    5) The Build Time Assurance only applies to the following types of homes:
    a) a single-storey home on a green title or survey strata lot;
    b) duplex and triplex developments on a strata title lot (each home will be the subject of a separate contract);
    c) a home that has a design from the New Choice Homes standard design range (up to a maximum of 300m2);
    d) the home design does not materially vary from the standard New Choice Homes design (as determined by New Choice Homes); and
    e) a home that is to be located in the Perth to Peel area between Dawesville in the south, Two Rocks in the north, Bullsbrook in the north-east (excluding Lower Chittering), and an area to the south-east as determined by New Choice Homes.
    When will the Build Time Assurance not apply or cease to apply?
    6) The Build Time Assurance does not apply in the following circumstances, and will cease to apply if any of the following occur after the relevant Preparation of Plans Agreement is signed:
    a) If there is a material variation to the design or specifications of the home, or if the building contract is materially varied in any way which impacts the time for completion of the work (as determined by us). This means that if you change your mind about the build, specifications or design of the home in a way that impacts on the time for completion, we can no longer promise to complete the home within 10 months after the first brick is laid.
    b) If you fail to provide any fixtures fittings or chattels which are required to be provided by you under the building contract at the time they are required to be provided for the works.
    c) If there are any building or other works relating to the home which are arranged by you. This means the Build Time Assurance does not apply if you arrange your own subcontractors or trades to perform any works to be carried out at the same time as the building work by us or specify that we are to use any specific subcontractors or trades.
    d) If the Preparation of Plans Agreement or building contract are terminated by any party.
    7) In the event that one or more of the events listed in section 6 above occurs, New Choice Homes may decide that the Build Time Assurance continues to apply, on certain terms and in its sole discretion.
    8) The Build Time Assurance will cease to apply if New Choice Homes determines that you have breached the terms of the Preparation of Plans Agreement or building contract. This would include failing to pay a progress payment or other amount when due. New Choice Homes will determine whether there has been a breach, and a breach will occur whether or not we’ve given a notice of default.
    What happens if there are delays outside of New Choice Homes’ control?
    9) The Build Time Assurance may be extended, at New Choice Homes’ election, if building works on the relevant home are delayed due to events or circumstances outside the reasonable control of New Choice Homes, so long as New Choice Homes taken reasonable steps to avoid that event or circumstance, including the matters listed below (Delay Event).
    10) These types of events include the following:
    a) breakdown of or accident to plant, machinery or equipment;
    b) a shortage in the supply of labour, materials or delays in transport;
    c) acts of vandalism, damage or theft in relation to the building;
    d) any restrictions or interruption (including the availability of materials or labour) which is required or directed by a government agency imposed to deal with the family of viruses known as novel coronavirus COVID-19;
    e) alterations to the building works;
    f) any interference to the building works by any act or omission by you;
    g) any delay caused by legal proceedings in respect of the property or building works or an order of a relevant authority;
    h) any other matter that extends the time for practical completion under the relevant building contract;
    i) an act of God, fire, explosion, earthquake, landslide, flood, washout, lightning, storm, tempest, or otherwise inclement weather;
    j) strike, lockout, holidays granted in accordance with industrial laws, stoppage or restraint of labour or other industrial disturbance or dispute (whether lawful or unlawful);
    k) war (declared or undeclared), act of public enemies, military action, insurrection, riot or civil commotion; or
    l) expropriation by any governmental or military agency or authority, sabotage, restraints, embargoes or other acts by any governmental agency or authority.
    11) If New Choice Homes determines that a Delay Event has occurred, New Choice Homes may by notice to you (at any time):
    a) extend the end of the Build Time Assurance by a period that is equal to the expected delay caused by the Delay Event (as determined by New Choice Homes); or
    b) cancel and terminate the Build Time Assurance.
    Compensation
    12) Subject to the above terms, if your home is not built to practical completion within 10 months from the date the first brick is laid, New Choice Homes will credit a weekly amount of $400 per week until the home is completed, up to a maximum of 5 weeks ($2,000 total).
    13) The total amount of any such credit shall be deducted from the next progress claim amount payable to New Choice Homes under the Building Contract.
    14) In the event of any claim for delay damages for late completion under the building contract, the amount credited in respect of the Build Time Assurance will be deducted from any delay damages otherwise payable.
    15) The amount of $2,000 is the total amount of any liability (under contract, statute or otherwise) that New Choice Homes may have to you arising out of or in connection with the Build Time Assurance.
    General
    16) These terms and conditions are governed by the law of Western Australia.

    17) The Promise 2.0 – “10 Month Build Assurance” end date: the 31st of December 2023

     

    The Promise 2.0 – “15 Month Maintenance Period”

    These terms and conditions apply to the promotion by Essential First Choice Homes Pty Ltd (ACN 138 185 341) trading as New Choice Homes (New Choice Homes, us, we, our) known as the “15 Month Maintenance Period”, under which New Choice Homes assures, represents or states to customers or potential customers (you or your) that a home built by New Choice Homes will receive an extended maintenance period up to 15 months from the date of practical completion.
    Extended Maintenance Period
    1) Upon Practical Completion, the Client has the option to select either a 5-, 10- or 15-month Post Completion Maintenance Period (Maintenance Period). The selection must be notified to New Choice Homes in writing within 4 weeks of Practical Completion being reached. If no selection is made by the Client, then a 5-month Maintenance Period shall apply.
    2) During the Maintenance Period, the Client may issue a notice to New Choice Homes on one occasion (only) of any items that the Client considers require maintenance, by completing the ‘Maintenance Notice Form’. The Maintenance Notice Form must be received by New Choice Homes either during the Maintenance Period or by no later than 2 weeks after the Maintenance Period has expired. If the Maintenance Notice is not received within this period, the Client waives any rights in respect of the Maintenance Period.
    3) Upon receipt of the Maintenance Notice, New Choice Homes will arrange for an inspection to be undertaken of the items listed in the Maintenance Notice during business hours. The Client must make available all areas of the home for the inspection at the required time (Maintenance Inspection). Following the Maintenance Inspection, New Choice Homes shall undertake such works as it considers are required to attend to the items identified. The extent of the work to be undertaken (if any) is within the sole discretion of New Choice Homes. The Client must provide access during business hours as required for any works.
    4) New Choice Homes shall not accept any responsibility for attending to items that result from misuse, wear and tear and/or damage to the home. The rights under the Maintenance Period are in addition to those rights in respect of the defects liability period in the Contract.
    What contracts and homes does the 15 Month Maintenance Period apply to?
    5) The 15 Month Maintenance Period only applies to the construction of a home that is the subject of a signed Preparation of Plans Agreement entered into between 10th November 2022 to the 31st of December 2023 (inclusive) (Offer Period), which is not terminated.
    6) If you do not enter into a Preparation of Plans Agreement during the Offer Period, the 15 Month Maintenance Period does not apply. The Offer Period may be extended at New Choice Homes’ sole discretion.
    7) Contracts and homes that have notified New Choice Homes of their selection to extend their maintenance period to either 10 months or 15 months.
    When will the Build Time Assurance not apply or cease to apply?
    8) The 15 Month Maintenance Period does not apply in the following circumstances, and will cease to apply if any of the following occur after the relevant Preparation of Plans Agreement is signed:
    a. If you fail to provide in writing your selection extend the maintenance period by either 10 months or 15 months within 4 weeks of Practical Completion being reached.
    b. If the Preparation of Plans Agreement or building contract are terminated by any party.
    9) In the event that one or more of the events listed in section 8 above occurs, New Choice Homes may decide that the Build Time Assurance continues to apply, on certain terms and in its sole discretion.
    The Build Time Assurance will cease to apply if New Choice Homes determines that you have breached the terms of the Preparation of Plans Agreement or building contract. This would include failing to pay a progress payment or other amount when due. New Choice Homes will determine whether there has been a breach, and a breach will occur whether or not we’ve given a notice of default.
    General
    10) These terms and conditions are governed by the law of Western Australia.

    11) The Promise 2.0 – “15 Month Maintenance Period” end date: the 31st of December 2023

     

    The Promise 2.0 – “Independent Building Inspector”

    These terms and conditions apply to the promotion by Essential First Choice Homes Pty Ltd (ACN 138 185 341) trading as New Choice Homes (New Choice Homes, us, we, our) known as the “Independent Building Inspector”, under which New Choice Homes assures, represents or states to customers or potential customers (you or your) that a home built by New Choice Homes will have the option to have two independent building inspections carried out at no additional cost by Home Integrity Building Consultants.
    To ensure your peace of mind that your new home has been constructed as required by the Contract and all applicable codes and standards, New Choice Homes offers to arrange and cover the costs of two (2) building inspections by ‘Home Integrity Building Consultants’.
    This offer applies to a contract entered into for the construction of a New Choice Home between 10th November 2022 and 28th February 2023 and entitles the Client to elect to receive two (2) building inspections on the terms as set out below. Terms used in this offer are as per the Contract.
    Home Integrity Building Consultants are an independent building inspection company (Home Integrity). Home Integrity will conduct up to two (2) independent inspections of your new home to assess the construction against the plans, specifications and applicable codes and standards.
    First Inspection – Roof Frame
    The first inspection will be performed at completion of the roof frame stage, and includes an extensive review of all elements relating to the home’s structural integrity, including inspections of: plumbing and electrical layouts; the visible slab; window and door frame locations and installation; brickwork; tie-down points and straps, and roof construction.
    Second Inspection – Practical Completion
    The second inspection will be performed when your home is at Practical Completion. The inspection will thoroughly review the final construction and finishes and Home Integrity’s building inspector will meet with you on-site and review and assess any additional items you may identify.
    After the Inspection
    The New Choice Homes site supervisor for the home will receive a copy of the report in order that they can attend to any issues identified.
    Home Integrity will contact you by phone after each inspection to discuss the inspection report and provide you with an extensive checklist of the items covered. The building inspector can be contacted to assist with any concerns identified in the report.
    On receipt of the report New Choice Homes shall undertake such works as it considers are required to be attended to in order to achieve Practical Completion and handover, and attend to any other items during the Defects Liability Period. The Client must provide reasonable access during business hours as required for any works attended to after handover.
    Should you elect not to accept this offer, then you are of course free to choose an alternative building inspector (at your own expense).
    What contracts and homes does the Independent Building Inspector promotion apply to?
    1) The Independent Building Inspector promotion only applies to the construction of a home that is the subject of a signed Preparation of Plans Agreement entered into between 10th November 2022 to the 31st of December 2023 (inclusive) (Offer Period), which is not terminated.
    2) If you do not enter into a Preparation of Plans Agreement during the Offer Period, the Independent Building Inspector promotion does not apply. The Offer Period may be extended at New Choice Homes’ sole discretion.
    3) Contracts and homes that have notified New Choice Homes in writing of their wish to accept the offer to appoint Home Integrity as their independent building inspector.
    When will the Independent Building Inspector promotion not apply or cease to apply?
    4) The Independent Building Inspector promotion does not apply in the following circumstances, and will cease to apply if any of the following occur after the relevant Preparation of Plans Agreement is signed:
    a. If you fail to provide in writing your wish to appoint Home Integrity as their independent building inspector.
    b. If you notify New Choice Homes in writing that you do wish to appoint Home Integrity as your independent building inspector.
    c. If the Preparation of Plans Agreement or building contract are terminated by any party.
    5) In the event that one or more of the events listed in section 4 above occurs, New Choice Homes may decide that the Build Time Assurance continues to apply, on certain terms and in its sole discretion.
    The Independent Building Inspector promotion will cease to apply if New Choice Homes determines that you have breached the terms of the Preparation of Plans Agreement or building contract. This would include failing to pay a progress payment or other amount when due. New Choice Homes will determine whether there has been a breach, and a breach will occur whether or not we’ve given a notice of default.
    General

    These terms and conditions apply to the promotion by Essential First Choice Homes Pty Ltd (ACN 138 185 341) trading as New Choice Homes (New Choice Homes, us, we, our) known as the “10 Month Build Time Assurance”, under which New Choice Homes assures, represents or states to customers or potential customers (you or your) that a home built by New Choice Homes will be built within 10 months.

    The Build Time Assurance

    • Subject to these terms and conditions, New Choice Homes undertakes that practical completion of a home the subject of a signed Preparation of Plans Agreement will be no longer than 10 months after the first brick is laid on your home (as determined by New Choice Homes, acting reasonably) (Build Time Assurance).
    • These terms are important. You should read them.  These terms outline when the Build Time Assurance does not apply.  These terms also set out when New Choice Homes does not have to comply with the Build Time Assurance.

    What contracts and homes does the Build Time Assurance apply to?

    • The Build Time Assurance only applies to the construction of a home that is the subject of a signed Preparation of Plans Agreement entered into between 14 March 2022 to 30 November 2022 (inclusive) (Offer Period), which is not terminated. If you do not enter into a Preparation of Plans Agreement during the Offer Period, the Build Time Assurance does not apply. The Offer Period may be extended at New Choice Homes’ sole discretion.
    • The Build Time Assurance only applies to the following types of homes:
      1. a single-storey home on a green title or survey strata lot;

      4. If the Preparation of Plans Agreement or building contract are terminated by any party.
    • The Build Time Assurance will cease to apply if New Choice Homes determines that you have breached the terms of the Preparation of Plans Agreement or building contract. This would include failing to pay a progress payment or other amount when due.  New Choice Homes will determine whether there has been a breach, and a breach will occur whether or not we’ve given a notice of default.

    What happens if there’s delays outside of New Choice Homes’ control?

    • The Build Time Assurance will be extended, at New Choice Homes’ election, if building works on the relevant home are delayed due to events or circumstances outside the reasonable control of New Choice Homes, so long as New Choice Homes taken reasonable steps to avoid that event or circumstance, including the matters listed below (Delay Event).

      5. breakdown of or accident to plant, machinery or equipment;
      6. a shortage in the supply of labour, materials or delays in transport;
      7. acts of vandalism, damage or theft in relation to the building;
      8. any restrictions or interruption (including the availability of materials or labour) which is required or directed by a government agency imposed to deal with the family of viruses known as novel coronavirus COVID-19;
      9. alterations to the building works;
      10. any interference to the building works by any act or omission by you; or
      11. any delay caused by legal proceedings in respect of the property or building works or an order of a relevant authority;
      12. any other matter that extends the time for practical completion under the relevant building contract.
    • If New Choice Homes determines that a Delay Event has occurred, New Choice Homes may by notice to you (at any time):
      1. extend the end of the Build Time Assurance by a period that is equal to the expected delay caused by the Delay Event (as determined by New Choice Homes); or
      2. cancel and terminate the Build Time Assurance.

    Compensation

    • Subject to the above terms, if your home is not built to practical completion within 10 months from the date the first brick is laid, New Choice Homes will pay you a weekly amount of $400 until the home is completed, up to a maximum of 5 weeks. Those payments will be taken into account in respect of the payments to be made under the relevant home building contract.

    General

    • These terms and conditions are governed by the law of Western Australia.

    If the Builder is unable to meet the ‘6 Month Start Time Guarantee’ The Builder ‘New Choice Homes’ will pay a weekly amount of $400 for up to a maximum of 6 weeks.

    The ‘120-days Price lockdown’ Promotion:

    • Timing will commence once the builder provides a ‘Certificate of Acceptance’ and will run for 120 calendar days inlcuding weekends and public holidays
    • Delayed commencement of construction allowance to be used if the Land is untitled or needs planning.
    • The Builder takes no responsibility for any delays outside the builder’s control not limited to the following,
    • Titling of the Land by the Developer
    • The Purchases ability to obtain Finance
    • Finance delays either by the lender or client

  • REFER A FRIEND PROMOTION

    A referrer is the person who refers an individual to the company. The referrer will receive $1000 paid into their nominated bank account 30 days after the referred persons home has gone into construction and Slab has been laid.

    To be eligible for the promotion the following terms and conditions must be met by the referrer

    • The referrer must give their full name and address and referring person’s full details on either New Choice Homes website or filling out our referral form.
    • The referred person’s must have not have already inquired with New Choice Homes prior to New Choice Homes receiving the referred person’s contact details from the referrer. No referral fee will be paid in this instance.
    • The referrer can refer more than one referral but must fill out a separate entry link for each referral.
    • Where a Referral Friend is referred by more than one referrer, then only the first referrer will be eligible to receive the promotion.
    • The company reserves the right to end the promotion at any time.
    • Referrer is required to sign a recipient created tax invoice before payment can be made.
